This request requires both an approved Zoning Examiner Special Exception and approval by the Board of Adjustments. The Zoning Examiner has the authority to apply conditions to minimize potentially injurious effects on adjacent properties. The request for a wall exceeding the allowable height and for reduced setbacks is not within the powers granted to the Zoning Examiner. Reducing the setback to zero feet or increasing the height of the wall outside of the allowed range potentially impact neighboring properties to a greater extent. The Zoning Examiner can impose conditions which minimize the negative impact of a development, but now vary standards which would increase the negative impact. The Board of Adjustments can allow a variance for a standard that exists across all zones and that could not be resolved through a rezoning action. |
