The Zoning Examiner may impose conditions minimizing potentially injurious effects on adjacent properties - these conditions can be more restrictive than what would normally be allowed per code. The Zoning Examiner cannot waive or modify the UDC in such a way that waives development standards. Review by the Board of Adjustments will be required for the proposed reduction of setbacks on the east and north property boundaries, and for the wall in excess of 10 feet. The Special Exception Land Use request should appear before the Zoning Examiner prior to appearing before the Board of Adjustment - the Board of Adjustment rules on waiving dimensional standards, but should make a determination after the Zoning Examiner has authorized a special exception land use. The Zoning Examiner may impose conditions requiring the Board of Adjustments waive dimensional standards prior to construction taking place. The design compatibility report should be updated to reflect the correct procedures for approval. The Preliminary Development Plan shows an encroachment of the proposed perimeter wall into the parcel adjacent to the east. Please update the PDP to demonstrate no encroachment is proposed. |
