Upon completion of the conditions below, the applicant is authorized to use a portion of the FEMA Special Flood Hazard Area Zone AH floodplain within the Alamo Wash (TSMS GC) watershed per the Flood Insurance Rate Maps 04019C 2301L & 2303L, specifically described as: portions of the existing public drainage easement Dkt982/pg206 on parcel 128-01-0040 (new grated inlets at Sears) and parcel 127-09-011P (outlet improvements at 6121 E Broadway), within Ward 6, T14S R14E Sections 12 & 13; for the purpose of Alamo Wash stormdrain improvements within a jurisdictional FEMA floodplain.
The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard Area Regulations, and is bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Unified Development Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations require application for, review and approval of an additional Floodplain Use Permit.
This permit becomes invalid and is subject to additional floodplain review, if there are any changes to the configuration of the improvement, or, if there is any further disturbance within the floodplain other than that outlined in this application. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from development within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson.
Except as approved by City Engineer prior to start of construction, development under this permit shall not obstruct, retard or divert existing flow of floodwaters from or to adjacent properties. Disturbance of the floodplain is only permitted as per approved plans.
Floodplain use permit may be issued based on following 10 conditions:
1) Sequence number for blanket access easement for outlet shall be provided at as-built or PIA stage, as determined by TDOT.
2) An addendum to the drainage report will be provided by drainage engineer and minor clarification on plans will be provided by EOR, either prior to PIA approval, prior to construction permit issuance, or at as-built stage, as previously discussed with PDSD Engineering.
3) Call for Pre-construction meeting, intermediate inspections, and final inspections. PDSD Engineering Inspections for stormwater controls, grated inlets, and outlet area are required during construction and prior to final floodplain inspection. 4) Within 5 days of this permit's issuance & through project completion, notification must be posted and maintained in a conspicuous place on job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T14OT00396 FOR INFORMATION PLEASE CALL 791-5550." This Floodplain Use Permit and plans shall be kept in a readily accessible location on site at all times.
5) This permit is specific to the drainage report approval. Drainage report (Alamo Wash: Indian House Road to Wilmot Road CLOMR TDN and associated addenda, was prepared by Jiankang Wang P.E., CMG Drainage Inc, sealed 9/30/2014, for the proposed improvements for the existing culvert system which is associated with Alamo Wash Floodway Mitigation plans prepared by Jeff Behrana P.E., Optimus Civil Design Group, sealed 12/3/14 and associated revisions. See floodplain use permit T15OT00065 for outlet design approval. See associated and subsequent PIA plans that will act as construction plans.
6) Any additional future disturbance of the floodplain shall have separate floodplain use permit applications submitted to this office for review and approval.
7) Renewal of this permit may require a new application, review and approval of that application by the City of Tucson Planning & Development Services Department, Engineering Division. This permit may be renewed for up to one year at the sole discretion of the City Engineer or designated representatives.
8) Prior to final floodplain inspection approval, finished-construction as-builts are required to be submitted to PDSD Engineering for review and approval.
9) After construction is completed, certified as-built information must be submitted to FEMA for the purpose of obtaining the LOMR. Asbuilts shall be first submitted to City of Tucson PDSD Engineering Division with the final as-built documentation before final inspection approval of City of Tucson floodplain use permits. As-built documentation shall include as-built plans showing easement recordation information, outlet, field testing reports / certification by engineer of record, and substantial completion letters by drainage and civil engineers of record.
10) Upon acceptance of as-builts by City of Tucson and with issuance of the LOMR by FEMA, subsequent permits within the revised area may be allowed to be issued based on the new LOMR data.
This Floodplain Use Permit will be automatically revoked & becomes invalid if conditions are not complied with, as set forth in permit.
