The drawings for the proposed final plat of the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


1. A Sewer Service Agreement was emailed to you on June 5, 2006. This needs to be executed in triplicate and returned to us for further processing. The Mylars for this project cannot be approved until these documents are received by us.

SUBJECT TO THE ABOVE, the Pima County Department of Environmental Quality and the Wastewater Management Department hereby approve the above referenced submittal of the Final Plat as received by us on December 5, 2006.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality Department.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating, or engaging in any activity which may cause or contribute to air pollution.

The subject project has been reviewed. We offer the following comments:

Final Plat:

1. Drexel Road right of way shown on Sheet 5/17 appears to stop short of the property line. It is not clear if the right of way dimension is wrong or the property line location is not correct (D.S. 2-03.6.5.B.).
2. Although the existing Nebraska Road appears to be on private land and does not have a dedicated right of way, it appears that it is being used by several parcels for access. Eliminating or blocking the roadway might create some access problems for the adjacent neighbors. Additionally, even if the roadway is not being used for access by the public, most of Nebraska road is dedicated as a sewer and telephone easement, which means that access to the utility companies has to be maintained. Investigate this issue and check with all the adjacent parcels owners (including Pima County) and impacted utilities if they currently use this road for their primary access and if they still need it to stay this way. This Office recommends setting up a meeting, with City Staff to address the access issue and hopefully resolve it. Contact the Civano Project Manager (Hector Martinez at 791-4545, Ext. 108) to set up the meeting.

Assurances

The submittal did not include a copy of the assurance package. Provide a revised Assurances Package that includes the following information:

1. Add, in Exhibit "B", the following as a separate assurable item "All applicable fees, e.g. permit fees, impact fees must be paid in full to the City of Tucson prior to the final release of subdivision assurances.
2. Revise the description of Common Area "B" through out the Assurance document to match the Final Plat.
3. Include the "Trust Agreement" in the Assurances Package.
4. Include the "Special Warranty Deed" in the Assurances Package.
5. Include in the Assurances Package and up to date Title report.
