Please find ES response to Bautista, 3rd Submittal Review of DP21-0157 as follows:

1. Container capacity for recycling service, noted on Page 4, should be, at minimum, a 4cy container with the ability to be rolled out/in for service. The enclosure detail, construction note 26, should include at least a 6 ft wide opening to allow for rolling a 4cy out/in, with wall protection. It can be assumed the pick-up area will be the same as the trash/recycle room containers and reflect as such.

2. Enclosure detail on page twelve should be modified to include provisions for a 4cy container. 95 gallon automated plastic containers will not approved for this development.

3. Enclosure detail figure 1 notes, " SCHEDULE 40 C.S. PIPE BOLLARDS FILLED WITH CONCRETE 4" ABOVE SLAB, it should be corrected to reflect as identified in figure 2, SCHEDULE 40 C.S. PIPE BOLLARD FILLED W/ CONCRETE, 4'-0" ABOVE SLAB, in order to be consistent and avoid confusion.

4. Proposed trash rooms and collection areas, as shown, are adequate.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is June 20, 2022.

2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

2-06.4.7.A - Zoning and Land Use Notes

1. This comment was not fully addressed. Review UDC Table 4.8-4: PERMITTED USES - COMMERCIAL AND MIXED USE ZONES and provide the applicable Use Specific Standards for General Merchandise Sales, excluding Large Retail Establishment. Retail is a Use Group not a use, clarify what use you are proposing under the Retail Use Group and provide all applicable Use Specific Standards. Restaurant is not a use listed in the UDC and should be listed as Food Service, Excluding Soup Kitchens, subject to Use Specific Standards 4.9.4.M.1 and 4.9.13.P. COMMENT: 2-06.4.7.A.4 - Zoning and land use note 4 states “THE PROPOSED USES ARE AS FOLLOWS: but only lists one use “RESIDENTIAL (APARTMENTS)” and this use is not a use listed in the UDC and should be listed as Multifamily. Plus clarify what other uses are proposed and list them as a use that is classified in the UDC and if applicable list any associated Use Specific Standards.

2. This comment was not addressed. COMMENT: 2-06.4.7.A.7 – As some type of land split, lot line reconfiguration is proposed provide the case number adjacent to the title block. This process will need to be completed prior to approval of this DP.

2-06.4.7.A.8 - For development package documents provide:

2-06.4.8 - Existing Site Conditions
The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided.

3. This comment was not addressed. COMMENT: 2-06.4.8.B – All existing easements shown to be abandoned will need to be abandoned prior to approval of this DP.

4. This comment was not addressed. COMMENT: 2-06.4.8.B – There is a “55’ INGRESS/EGRESS & UTILITY EASEMENT’ shown to be partially under the north side of the propose building. This easement will need to modified or abandoned prior to approval of this DP.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

5. This comment was not addressed. COMMENT: 2-06.4.9.A – A lot line reconfiguration will need to be processed prior to approval of this DP.

6. This comment was not addressed. Zoning was only able to find 41 short-term bicycle parking spaces shown on the plan. If the racks called out under Keynote 17 located near the northwest corner of the building are to hold 2 bikes then provide a detail that demonstrates how the requirements of UDC Articles 7.4.9.B.2.f are met, Each required short-term bicycle parking space must be at least two feet by six feet or a total of 4’-0” clear between racks. Demonstrate how the requirements of UDC Articles 7.4.9.B.1.e are met for the short-term bicycle parking. Also Keynote 17 sheet 3 references a detail on sheet 23 but there are not bicycle parking details on sheet 23. No short-term detail provided on sheet 11. Also, the required long-term bicycle parking for the Food service and Retail cannot be provided within the residential dwelling units. COMMENT: 2-06.4.9.H.5.d – Provide a detail for both short- & long-term bicycle parking that demonstrates how the requirements of UDC Article 7.4.9.B, .C & .D are met. For your information the long-term bicycle parking can be located within each multifamily dwelling unit and not detail would be required.

7. This comment was not addressed. COMMENT: 2-06.4.9.L – All proposed easements will need to be recorded prior to approval of this DP.
