This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

THE ON-SITE SEWERS ARE EXISTING AND PRIVATE. NO NEW SEWERS ARE PROPOSED.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the development plan. The required revision(s) may be shown on the Mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

02/13/2009 MATT FLICK ENGINEERING REVIEW Denied DSD Engineering recommends DENIAL of the development package and offers the following comments:

1. The SWPPP (T09BU00107) is inadequate and does not contain the necessary information for COT approval and conformance with ADEQ requirements. The following comments are offered:

a. The consultant shall use the ADEQ "2008 Construction General Permit SWPPP Guidance Checklist" for preparation of the SWPPP and include a copy of the completed checklist with the next submittal.

b. Please refer to the ADEQ website "http://www.azdeq.gov/function/forms
/appswater.html#azpdes"
for a copy of the SWPPP checklist.

2. A copy of the completed and signed NOI must be submitted with the SWPPP. The NOI must have the ADEQ-issued AZCON authorization number. It is recommended that ADEQ's Smart NOI system be used. The NOI and NOI instructions can be found on the fore-mentioned ADEQ website.

3. The City of Tucson requires the SWPPP to be sealed by an Arizona-registered P.E. (Civil).

A resubmittal of the C-sheets and SWPPP is required.

DEVELOPMENT PLAN COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is January 26, 2009.

2. The following comments are based on the Development Standards 2-01.0.0 DEVELOPMENT PACKAGE DOCUMENTS, dated 2-26-08. This review is a full code review for the areas of expansion only.

3. D.S. 2-01.3.1 If available provide the email addresses for owner, developer, architect, civil engineer and landscape registrant(s) on the plan.

4. D.S. 2-01.3.2 & D.S. 2-01.2.4 Provide a title block in the lower right quadrant of each sheet that includes the following:
a. The proposed name of the project or subdivision, or if there is no name, the proposed tenant's name.
b. A brief legal description and a statement as to whether the project is a resubdivision are to be provided. On resubdivisions, provide the recording information of the existing subdivision plat.
c. The administrative street address.

5. D.S. 2-01.3.3 List the following reference case numbers adjacent to the title block on each sheet, "D09-0001, C9-00-23, C15-00-05, C10-00-73, D00-0059".

6. D.S. 2-01.3.4 The location map appears to have the Pima County/ City of Tucson boundary shown incorrectly. The location map shows this parcel within Pima County. Revise the location map to show the correct County/ City of Tucson boundary.

13. D.S. 2-01.3.7.A.9.b Provide a Floor Area Ration (FAR) calculation, including the allowed FAR and proposed FAR, on the plan. The FAR calculation will need to be broke out in two sections, one (1) for the Approach Departure Corridor 2 (ADC 2) area of the site and one (1) for the Approach Departure Corridor 1 (ADC 1) area of the site. See LUC Sections 2.8.5.8.B.1.c and 2.8.5.8.C.1.a for the allowed FAR. See LUC Section 3.2.11 for FAR calculation requirements.

14. D.S. 2-01.3.7.A.9.c Provide a building area expansion calculation on the plan.

15. D.S. 2-01.3.8.B All easements shall be drawn on the plan. The recordation information, location,
16. width, and purpose of all easements on site will be stated. Blanket easements should
17. be listed in the notes, together with recordation data and their proposed status.
18. Should an easement not be in use and be proposed for vacation or have been
19. abandoned, so indicate. However, should the easement be in conflict with any
20. proposed building location, vacation of the easement shall occur prior to approval of
21. plan unless written permission from easement holder(s) is provided.

22. D.S. 2-01.3.8.C For all existing public right-of-way (ROW's) adjacent to the site provide the right-of-way width, both existing and future if applicable, dimension the curbs, curb cuts, and sidewalks.

23. D.S. 2-01.3.9.F All existing zoning classifications on and adjacent to the project (including across any adjacent right-of-way) shall be indicated on the drawing with zoning boundaries clearly defined.


24. D.S. 2-01.3.9.G.2 Show future and existing sight visibility triangles. On a designated MS&R street, the sight visibility triangles are based on the MS&R cross-section.

25. D.S. 2-01.3.9.G.5.a The vehicle parking space calculation is not correct. Zoning acknowledges that a Board of Adjustment for Variance, #C9-00-23, was approved for the existing development, D00-0059. This variance does not apply to the proposed expansion therefore per LUC Section 3.3.4, INDUSTRIAL USE GROUP, Perishable Goods Manufacturing, parking must be provided at a ratio of one (1) space per five hundred (500) sq. ft. GFA of the expansion. 91,650/500 = 183 vehicle parking spaces required for the proposed expansion. Revise the calculation and show the require vehicle parking along with access to, on the plan. Provide the accessible vehicle parking for the new required vehicle parking as required be the International Building Code. Provide the required parking space details for both a standard and accessible vehicle parking space.

26. D.S. 2-01.3.9.G.5.c The loading space calculation is not correct. Per LUC 3.4.5.1 one (1) additional spaces is required for the expansion therefore the "REQUIRED" number of loading spaces should show seven (7).

27. D.S. 2-01.3.9.G.5.d For any new vehicle parking spaces bicycle parking must be provided at a ratio of 8%, 90% Class 1, 10% Class 2. Show the location on the plan and provide a bicycle parking calculation, required and provided, on the plan along with details for both Class 1 & Class 2 the meet the requirements of D.S. 2-09.0

28. D.S. 2-01.3.9.K If applicable show all proposed easements on the site plan. Dimension and label as to their purpose and whether they will be private or public.

29. D.S. 2-05.3.9.P Provide the square footage and the height of each commercial, industrial, or business structure, existing and proposed, and the specific use proposed within the footprint of the building(s).

30. D.S. 2-05.3.9.V If applicable provide the location, type, size and height of existing and proposed freestanding signage and billboards on the plan.
