Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is July 13, 2025. SECTION 2-06.0.0: DEVELOPMENT PACKAGE (TENTATIVE PLATS AND SITE PLANS) 2-06.4.9 - Information on Proposed Development The following information on the proposed project shall be shown on the drawing or added as notes. 1. COMMENT: 2-06.4.9.E – Follow up to previous comment 5: Review fees for TD-DIV-0224-00016 are still outstanding. Please be aware DP cannot be approved until the lot reconfiguration fees have been paid in full. Previous comment 5: It appears that some type of lot line reconfiguration is proposed. The proposed process must be approved prior to approval of this DP. Provide the case number for the process adjacent to the title block on all sheets. 2. COMMENT: 2-06.4.9.H.5.d - Show bicycle parking facilities fully dimensioned. For specifics, refer to Section 7.4.9, Bicycle Parking Design Criteria, of the UDC. Provide, as a note, calculations for short and long term bicycle spaces required and provided. Per UDC Table 7.4.8-1, a minimum of 2 long term bicycle parking spaces are required for the Commercial Use Group. Please revise the bicycle parking calculations to include 2 long term spaces required and show location on the site plan. Also, please provide a dimensioned detail of the short term bicycle parking rack in compliance with the dimensions as noted on UDC Figure 7.4.9-B. It appears the bicycle rack will interfere with the truncated domes. 3. COMMENT: 2-06.4.9.L – Follow up to previous comment 7: Please delineate the reciprocal easement areas on the site plan. Previous comment 7: As cross access is proposed between this site and the proposed parcel to the east and to the parcel to the west some type of recorded easement/agreement is required. Indicate on the plan what is proposed and provide recorded copies of the documents. 4. COMMENT: 2-06.4.9.O – Follow up to previous comment 8: Previous comment 8 not addressed. Building must meet the minimum setback of 10’ from major street and routes. Please provide City of Tucson contact who said this comment is inaccurate. Previous comment 8: The street perimeter yard shown on the plan is not correct. Per UDC Article 6.4.5.C.2.a, the required perimeter yard setback is 10’ as measured from the existing or future property line as determined by the adopted Major Streets and Routes Plan, whichever is greater. 5. COMMENT: 2-06.4.9.R - Show on-site pedestrian circulation and refuge utilizing location and the design criteria in Section 7-01.0.0, Pedestrian Access, of the Technical Standards Manual. Per UDC section 7-01.4.1.G, sidewalks or crosswalks cannot cross any type of stacking areas for drive-through lanes. Please revise the pedestrian circulation path to comply with the Preliminary Development Package. Any pedestrian circulation adjacent to a stacking area must have raised concrete sidewalks and accessible ramps as required. 6. COMMENT: 2-06.4.9.U – Follow up to previous comment 9: A 5’ high wall shall be provided along the North side of the subject rezoning site extending to the eastern property line. Previous comment 9: Indicate graphically, where possible, compliance with conditions of rezoning.
