COMMENTS: The following comments are for the purpose of applying for a variance before the Board of Adjustment (UDC Section 3.10.1).

This site is located in the R-1 zone (UDC 4.7.1). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.5 - 9. 10.

Perimeter yard setbacks are based on a measurement from design grade to the highest point of the exterior wall, see UDC Article 6.4.5.B & Figure 6.4.5-A

The minimum setback to the front street perimeter property line is the greater of twenty (20) feet, or one and one-half (1 ½) the height of the proposed wall ((UDC 6.4.5.C.1.a).
The DDO process may only be used to reduce the driveway length to a carport, and not to a garage (UDC Section 3.11.1.B.4). A Board of Adjustment for Variance will need to be submitted and approved. Variance application and requirements can be found at: https://www.tucsonaz.gov/files/pdsd/codes/Zoning_Administration_Application_BA_fillable.pdf.

1. Based on a wall height of 11’-0” the required front street perimeter yard setback from the proposed attached garage to the north property line is 20’-0”, proposed perimeter yard setback is 15’-0”.

The minimum setback to the back of a sidewalk for a garage is nineteen (19) feet (UDC Section 6.4.5.C.2.b.1). The minimum driveway length for a garage is eighteen feet to the property line (UDC Section 6.4.5.C.2.b.1.a & b.).

2. Based on a sidewalk location 1’-0” north of the property line the 19’-0” distance is not met, proposed is 16’-0” with a minimum driveway length of 15’-0” proposed.
The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A).

3. Based on a wall height of 14’-0” the required perimeter yard setback from the room addition to the west property line is 9’-4”, proposed perimeter yard setback is 7’-0”.

4. Based on a wall height of 11’-0” the required perimeter yard setback from the proposed attached garage to the west property line is 7’-4”, proposed perimeter yard setback is 5’-6”.

All perimeter yard setbacks can be run through the Board of Adjustment process.

Additional comments that need to be addressed prior to approval of the building permit:

5. Provide permit documentation for the structure located in the southwest corner of the property, modified or replaced sometime after 2014 and the porch addition to the north side of the guest house sometime after 2012.
