The applicant is authorized to use a portion of the flood hazard area (FEMA Zone X, Panel 2277L, City of Tucson Flood Hazard Area) in the City of Tucson at 1222 North 4th Avenue for the purpose of making improvements to an existing residential building.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard regulations, and is particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed.

The following conditions shall apply to this permit:

1. All work shall conform to the attached plans (T12CM07649) which are made part of this permit.

2. The structure is listed as a contributing structure in the Feldmans Historic District (Speedway-Drachman). As a contributing structure it is exempt from the substantial improvement requirements of TCC 26-4.1. (See Sec. 26-2 Substantial Improvement)

3. The existing drainage patterns at the property lines shall not be obstructed or changed.

4. Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.

5. This permit becomes invalid and is subject to additional floodplain review, if any required development permit (s') changes the configuration of the structure and or site development.

6. Any patio walls to be constructed will require a separate Floodplain Use Permit. Any additional improvements to this structure or to any other structure on the property will require separate floodplain review.

This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions set forth in this permit are not complied with.
