If the set-aside methodology is used, the mitigation requirement is for a minimum of thirty (30) percent of the site to be set aside in perpetuity as NUOS area. The area to be set aside is required to be be delineated and legally described on the site plan (with recording data included) and legally protected by a document, such as a conservation easement (Exhibit C), recorded by the County Recorder. The set-aside method typically requires an Environmental Resource Report that identifies the areas of the site with highest natural resource value. In this case the area identified on the TDOT Map as "Critical and Sensitive Biological Communities" would be an acceptable delineation. |
