2) The site contains regulatory floodplain areas that may contain riparian habitat. This habitat may not unnecessarily altered per TCC Sec. 26-5.2. Refer to DS 9-06.0 for the preparation, submittal, and review procedures for development within areas that have environmentally valuable habitat in conformance with Article 1, Division 1, Floodplain and Erosion Hazard Area Regulations.

Submit a Waytercourse Environmental Resource Report (WERR) per DS 2-13.2.5.B.1 & DS 9-06 if encroachment is proposed in the regulatory area. The report will document (1) the areas that contain riparian and wildlife habitat that is to be preserved and (2) those areas without such habitat within the regulatory floodplain.

All tentative plats, development plans, site plans, plot plans or other plans providing for approval of development within property that includes any Regulated Area as defined in Development Standard 2-13.2.2.A shall identify and delineate the Regulated Areas and the Protected Riparian Area Revise the plans as necessary.

All development within the Protected Riparian Area shall be reviewed to insure that there is no unnecessary disturbance of the riparian resources. Refer to DS 2-13.2.5.B.2 for the section on Development Restrictions and revise the plans as necessary to comply.

Where any development encroaches within the Protected Riparian Areas, mitigation will be required. A mitigation report shall be submitted with the Environmental Resource Report demonstrating that the proposed mitigation is in conformance with this subsection and applicable codes. DS 2-13.2.5.C

Landscape plans are required to document compliance with the mitigation plan requirements. A summary of mitigation and preservation requirements shall be included on the plans. The plans shall show the location of mitigation areas; techniques used for mitigating impacts to, or preservation of, natural areas; specifications for restoration and revegetation of disturbed areas; and general compliance with the applicable standards. Revise as necessary.


Encroachments that cross the Protected Riparian Area shall be located and constructed to minimize disturbance of the habitat and wildlife movement and utilities will be placed either in proposed or existing public right of way along roadway, bike path, or paved walkway improvements or within approved easements. Discuss the location of the sewer crossing of the floodplain in the ERR.

Ownership of the Protected Riparian Area shall be provided in one or more of the methods set forth in DS 2-13.2.6 to insure continued preservation of the area. Refer to the standards and revise the plans and provide additional documentation as appropriate.

3) A Native Plant Preservation plan is required. If the set-aside methodology is used, the mitigation requirement is for a minimum of thirty (30) percent of the site to be set aside in perpetuity as NUOS area. The area to be set aside is required to be be delineated and legally described on the site plan (with recording data included) and legally protected by a document, such as a conservation easement (Exhibit C), recorded by the County Recorder.

The set-aside method typically requires an Environmental Resource Report that identifies the areas of the site with highest natural resource value. In this case the area identified on the TDOT Map as "Critical and Sensitive Biological Communities" would be an acceptable delineation. See attached Exhibit A.

4) Consider dedicating a portion of the property to the City for a trail easement. The Pima County Trails System Master Plan includes a Pantano Wash trail segment in the vicinity of the property. See Attachment B.

COMMENTS: Please attach a response letter with the next submittal, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.


1) This review is for a new single-family residence (SFR) in the SR Zone (LUC Section 2.2.4.2.A.1). Provide the correct zoning on the plot plan, in the site data information and on all the adjacent lots. The Development Designator is "C" (LUC Section 3.2.3.1.A) and the Perimeter Yard Indicator is BB (LUC Section 3.2.6.4). This site is subject to LUC Section 3.5.7.1.F.

2) It appears that the resent lot split (12-07-2005) has not been review and approved by the City of Tucson as required (LUC Sections 4.3.1, 4.3.2 & 4.3.3). In addition, two of the three parcels do not meet the minimum lot size requirements for the SR Zone (LUC Section 3.2.14). The minimum parcel size in the SR Zone is one hundred forty-four thousand (144,000) square feet (approximately 3.30 AC) (LUC Sections 2.2.4.A.1 & 3.2.3.1.A). Parcel 205-66-099D is listed as 2.04 AC, which is approximately eighty eight thousand eight hundred sixty two (88,862) square feet, by the Pima County Assessor. Parcel 205-66-099E is listed as eleven thousand seven hundred twenty (11,720) square feet, or approximately 0.27 AC. An approved lot split shall be required to proceed with an further development on this site. Troy has said that the client will use a lot combination.

3) Demonstrate minimum legal access to all proposed lots (LUC Sections 4.3.1, 4.3.3.B.7, 4.2.14.5.A, & .B, 3.2.8.2, 3.2.8.3). Access has been confirmed by Jose Ortiz, e-mail September 8th 2009.

4) There appears to be a SFR on the site according to the records with the Pima County Assessor and the aerial photos. The maximum number of units in the SR Zone is one (1) (LUC Sections 2.2.4.2.A.1 and 3.2.3.1.A). Provide a demo permit for the existing SFR.

5) The property lines on the plot plan are incomplete. Provide the correct property lines with dimensions on the plot plan. Also place dimension of the proposed structure and any existing structures to remain from the nearest edge of each structure to each property line (LUC Section 3.2.6.4).
