This Special Exception request is to allow a new cellular communications facility at 2699 S. Pantano Road where there is an existing automotive repair facility. The applicant proposes a 65-foot high stealth palm tree (65-fet to top of fronds) which will conceal the wireless communication antennas and will be located at rear yard (north) of the business. The stealth palm tree and ground equipment will be located behind a new 20' by 20' (400 square feet) masonry wall painted to match existing Garner Automotive building. The areas to the north, east and south of the parcel are zoned C-2 with R-2 zoning across the street west of Pantano Road.

Land Use Plan Policy Summary

Land use policy guidance is provided by the South Pantano Area Plan (SPAP) and the General Plan.
South Pantano Area Plan Commercial Policy 1 is to promote commercial development at appropriate locations in the area. The site is in Subarea 3 but the subarea policies do not address this proposal. However, the General Plan policies provide guidance for locating wireless communications facilities. Element 4 (Community Character and Design) Policy 3.7 is to require that, whenever possible, telecommunications facilities be located, installed and maintained to minimize visual impacts and preserve views. Policy 4.6 is to promote the coordination of efforts of government, private developers, and utility firms to improve the appearance of necessary aboveground utility lines and structures

The proposed 69-foot high stealth fan palm appears to be generally consistent in height with other palm trees in the general area, though this should be shown in the Special Exception application. Assuming that the species of palm is consistent with surrounding species the proposed use is in general compliance with the intent of the plans and no plan amendment is required. At the time of submittal staff will focus on the following issues.

· The stealth fan palm shall be no higher than 70' feet assuming there is similar verticality in the existing palms in the area.
· As shown on the site plan submitted with the application, an 8-foot high screen wall shall be required around the ground equipment. The exterior surface shall be stucco and it shall be painted to match the nearby buildings.
· Exterior paint shall be graffiti-resistant.
· Landscaping to be provided around perimeter of the CMU wall

Discussion

The applicant attended a pre-submittal meeting with staff on May 14, 2008 and held a neighborhood meeting on June 2, 2008. Two nearby property owners attended the meeting and where in support of the project. Sufficient information has been provided to demonstrate substantial compliance with the SPAP and the General Plan. A plan amendment is not required.

Recommendation

Staff recommends that this application be accepted for processing.

B. Require appropriate design elements (fences, walls, vegetation, etc.) during the rezoning and development review process when locating commercial uses in proximity to established neighborhoods.

SUBAREA THREE

Profile:

This is a three-square-mile area between Wilmot Road and Camino Seco and between Golf Links and Escalante Roads (see Subarea Three Map). This area, for the most part, is developed suburban density single-family residential. Higher density residential and commercial use is located along the arterials and collectors. Approximately 15 percent of the area is vacant land with the majority located along Golf Links Road and Wilmot Road. Five percent of the land is zoned commercial and another one percent is authorized for commercial. Of this 6 percent commercial property, approximately 80 percent is currently vacant.

There is an excessive amount of commercially zoned property in the Pantano East Area Plan which is located north of this plan area and east of Pantano Parkway. Consequently, the Pantano East Plan recommends there be a demonstrated need for additional commercially zoned land in that area. The commercial properties between Wilmot Road and Pantano Parkway border South Pantano on the north side of Golf Links Road and increase the total amount of available commercial land serving this subarea.

Proposed Use:

In an attempt to avoid excessive amounts of vacant commercially zoned land in this subarea, it is recommended that proposed rezoning of property for commercial use be reviewed on a case-by-case basis to determine whether or not that proposed development may be more appropriately located on currently vacant commercial property.


General Plan

Element 4:Community Character and Design,
Policy 3: Preserve scenic views of natural features and community landmarks.

Supporting Policy 3.7: Require that, whenever possible, telecommunications facilities be located, installed, and maintained to minimize visual impact, preserve views, and be consistent with the City's adopted land use plans and policies. Cabling and fiber optics should be installed underground where possible, and the visual impact of cellular towers will be a prime consideration in the City's acceptance and approval.

Policy 5: Promote neighborhood identity and visual character
5.5 A Consider incentive for telecommunications providers to install infrastructures, not only in the newer areas, but also in older neighborhoods to increase opportunities for all citizens to have access to high-tech telecom services.
