COMMENTS: Please resubmit revised drawings along with redlines and a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. After reviewing the site plan presented for permits the following items have been found to be incorrect and must be addressed before the site plan can be approved.

a. The area depicted as new NUOS on the site plan cannot be accepted at this time. The section of the presented NUOS area along the northwest portion of the site has been disturbed and landscaped. This area may not be used or counted towards the required percentage of NUOS area.

b. There appears to be sufficient undisturbed area to the east of the house and just north of the basketball court that can be calculated as NUOS area and is probably of sufficient size to meet the required percentage.

c. The 30-foot Scenic Corridor Buffer has also been disturbed and natural vegetation removed and not replaced. Per the site plan an area just east of the basketball court has been disturbed. This area was not designated as access to the property on the approved tentative or final plat. This area must be revegetated with similar vegetation in the NUOS area. An area within the 30-foot Scenic Corridor Buffer which is just southwest of the garage has also been disturbed and was not revegetated. The 30-foot Scenic Corridor Buffer must be revegetated with same as or similar vegetation as in the NUOS area.

d. The site plan submitted for review does not match the existing conditions on the site. The following are items related to the site that are inconsistent. The driveway is in the wrong location and configuration. The walls along the north, east and south sides of the house do not match what was built, The building footprint on the site plan does not match the actual building footprint, the pool and ramada in the rear yard (north side) were not depicted on the site plan, the landscaped area along the northwest side of the house was not depicted correctly, the landscaping along the southwest side of the garage was not depicted correctly on the plan (this may be an Scenic Corridor issue anyway that must be addressed). (The revised site plan must be accurate and consistent with the exiting conditions on the site. Accurate dimensions are needed in order to verify encroachment in to the SCZ buffer.)

e. After discussing the issues on the site plan with the Landscape Reviewer Joseph Linville the chain link fence around the basketball court may be an issue as well. My suggestion is to set up an appointment with Joseph Linville and me before resubmitting the site plan for review and approval. Please call Joseph at 837-4947 or David at 837-4957 for an appointment to discuss the site plan, issues associated with the violation, and solutions to approving plan that will lead to the abatement of the DNR violation notice.

f. If for any reason, other processes are needed, such as Board of adjustment variances those processes must be approved prior to approval of the site plan and any mitigation needed to abate the DNR violation.

g. In order to ensure that the newly revised NUOS area is depicted correctly a survey with distances and bearings of the site plan and depiction of the NUOS area will be required and will have to be recorded. In addition, a revised and replat of the final may be required. The Final Plat may be an item that is still up for discussion and additional verification. We may have the answer to that question by the time you setup a meeting with us.

01/28/2009 PETER MCLAUGHLIN NPPO REVIEW Denied 1) A Covenant, Condition, and Restriction (CC&R) shall be attached to the deed prohibiting the alteration of the proposed Natural Undisturbed Open Space (NUOS) before, during, or after development of the site. This CC&R shall be indicated on the site plan. Provide a copy of the revised legal description for the NUOS area and a new CC&R prior to recording.

2) Per LUC 3.7.2.7.D2, "Nonwood fences, such as chain link, may not be used along a street frontage along a Gateway Route or within the SCZ".

3) The 30' scenic route buffer area is to be revegetated with native plants indigenous to the site and the area is to be
reconstructed to look as natural as possible per
DS 2-06.7.1.B. Provide a revegetation plan.

4) All disturbed areas on the site that are visible from the Scenic Route and are not covered by permanent improvements shall be revegetated with native plants, plants from the Drought Tolerant Plant List, or a combination of both per LUC 3.7.5.2.D.2. Provide a revegetation plan.

5) The location of the proposed NUOS is inconsistent with the Preliminary Development Plan approved with rezoning case C9-00-32. Revise the plan to include the areas platted originally as NUOS and additional area to compensate for the
area of the sports court that will now be excluded from the NUOS. Any disturbed NUOS areas require revegetation with native plants. Provide a revegetation plan.
