Reflection Vista The Department of Urban Planning & Design has reviewed this Permit Application. /X/ Permit opposed for the reasons noted below. It appears that this permit application is a result of a violation that has been issued. The applicant has constructed an addition project (sports court) in an NUOS protected area. The applicant’s permit application is denied as the following is needed before a review can be process. The Rezoning Conditions (C9-00-32) for this project site requires that a Covenant, Condition, and Restriction (CC&R) be attached to any subdivision plat or deed prohibiting the alteration of the proposed NUOS before, during, or after development of the site. And this CC&R shall be indicated on any development plan or site plan. Please provide a copy of the CC&R’s with this site plan. The Rezoning Conditions (C9-00-32) for this project also required that the subdivision plat be in substantial compliance with the Environmental Resources Report (ERR). Please provide a copy of the pertinent sections from this ERR that relate to the NUOS areas for this project and site. Copies of the ERR can be obtained at Development Services – Records on the First Floor. Although the Site Plan submitted for this addition project shows the proposed NUOS areas, the Site Plan should also indicate the original NUOS set-aside area for Lot 1; and provide the calculations that show how this change in NUOS area meets the required 30% for the overall development project. The new construction addition of the Sports Court appears to encroach into the 30’ Scenic Route Setback. Please correct this setback.
