CDRC Engineering SUBJECT: Old Vail Plaza S07-156, T15S, R15E, SECTION 26 RECEIVED: Final Plat Mylar, Assurances and CC & R's on February 16, 2011 The subject submittal has been reviewed and it can not be approved at this time. Address the following comments before review can continue. Prepare a detailed response that explains the revisions that were made and references the exact location in the Final Plat, CC & R's and Assurances where the revisions were made: Final Plat Mylar: 1. The provided gross area information does not match the approved paper final plat and it is not consistent with the drawing shown on Sheet 2/5 and the project description in the title block. The proposed change requires the approval of Planning and Zoning review and CDRC. Contact Patricia Gehlen from CDRC for further instructions on how to address this issue properly. 2. Revise the name of the Planning and Development Services Department in the signature lines in the Assurances Block. 3. Provide adequate space for the State Stamp in the Acknowledgement Block. CC & R's: 1. Clarify where, in the CC & R's document, drainage facilities maintenance requirement is described in details. If it is not, provide a maintenance paragraph that details the maintenance requirement and explains how the drainage facilities need to be inspected by a registered civil engineer at least once a year and after major storms. It is recommended to include the Drainage Facilities Maintenance Checklist as an exhibit in the CC & R's to facilitate the Property Owners' Association maintenance responsibility. Assurances: 1. The Assurances and CC & R's documents may need to be revised in accordance with Comment #1 requirements. 2. Revise the Assurance document to remove the words "(Subdivision name)" every applicable place where the actual subdivision name is provided. 3. It seems that the 2008 date needs to be revised on Page 7 of 10 of the "Agreement to Construct…" Assurance document. 4. Fill in the Case Number on Page 10 of 10 of the Agreement. 5. Replace the name "Kathleen S. Detrick" with the current City Clerk's name "Roger W. Randolph". 6. Revise the paragraph numbered (1) of the "Amendment to Trust…" Assurance document to remove the words "(Subdivision name). 7. Replace the wording of "Book and Page" by "Sequence Number" in all appropriate places (e.g. Exhibit "A"). 8. Provide one more copy of the "Trust Agreement" and the "Warranty Deed".
