The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

We sent to your office via e-mail, a .pdf file containing a Sewer Service Agreement for the proposed number of residential lots. Three originals will need to be printed out from this file for notarized signatures by the Owner of Record. The three signed originals of the Agreement must be returned to this office in order to satisfy the necessary requirements needed to approve the Mylars of the final plat.

This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the final plat. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the third(3rd) submittal. A check for the review fee of this submittal in the amount of $39.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter. Final Plat:

1. Add a Beneficiary Block as required by D.S. 2-03.6.3.C.
2. Show required setback from detention/retention basins as required by (D.S. 2-03.6.4.E.). The setback will ensure that no buildings will be built adjacent to the basins in the future.

CC & R's:

Submit a revised CC & R's document in accordance with the following comments:

1. It appears that Sections 7.5, 7.6, and 10.1 have been numbered incorrectly in the Table of Contents.
2. Provide the complete project title on Page #1 (i.e. Mountain Vail Estates)
3. Why do we have two trust numbers on Page #1?
4. Exhibit "A" page should be either numbered or removed.

Assurances:

Provide an original and complete assurances package that complies with the following requirements:

1. Ensure that the Trust number matches the trust number information on the Final Plat and the CC & R's.
2. Remove the reference to the year 2008 where the New Year 2009 is needed.
3. Include the "Trust Agreement" in the Assurances Package.
4. Include the "Special Warranty Deed" in the Assurances Package.
5. Include in the Assurances Package an up to date Title report.
6. Ensure that the assurance package documents are accurate and complete. Inaccurate and incomplete package might delay the processing of the final plat mylar and assurances.

However, should there be any changes requested by other CDRC members, the Zoning Review Section approval is void, and we request copies of the revised final plat to verify that those changes do not affect any zoning requirements.

2. Revise the following items in the CC&R's document:

a. The cover sheet does not reference the complete name of the subdivision. The name on the plat is Mountain Vail Estates and labeled in the CC&R's as Mountain Vail. Please revise the name in several locations of the CC&R's accordingly. (Several pages must be revised.)

b. On page 20 section 5.2.3 the rezoning case number of C9-03-01is referenced. Yet I don't see that number referenced anywhere on the plans. If this is a typo revise the section as required with the correct rezoning case number.

c. On page 64, revise the 2007 date to 2009.
