GENERAL COMMENTS

1. The Drainage Report was reviewed for Tentative Plat purposes only.

2. Please include the Assurance Package with the Final Plat submittal. This package must include the original Third Party Trust, the original Amendment to Trust, a copy of the Trust Agreement, a copy of the Deed, and a Title Report.

3. Include a copy of the CC&Rs with the Final Plat submittal. The specific maintenance notes specified in the Standards Manual for Drainage Design and Floodplain Management, SMDDFM, 1.5.1 must be included on the Final Plat or in the CC&Rs. The term "owner" in the maintenance notes is to be replaced with "Homeowners Association".

4. Please provide a copy of the boundary closure calculations with the Final Plat submittal.

5. All proposed easements must be shown in a surveyable manner on the Final Plat.

Revise the landscape plan to include the following notes and revise all other plans if/as necessary to comply with the provisions.

1. Within the Scenic Route buffer area and the MS&R right-of-way, all areas between the MS&R right-of-way line and the existing street right-of-way that are disturbed by development shall be
re-vegetated with native vegetation.

2. Within the SCZ, excluding the Scenic Routes buffer area, all disturbed areas on the site that are visible from the Scenic Route and are not covered by permanent improvements shall be re-vegetated with native plants, plants from the Drought Tolerant Plant List, or a combination of both.

3. Cut and Fill. Exposed cut or fill slopes shall be no greater than a one (1) foot rise or fall over a three (3) foot length.
08/10/2005 DAN CASTRO ZONING REVIEW Approv-Cond The Zoning Review Section approves the tentative plat for this subdivision, subject to the following changes on the executed tentative plat. However, should there be any changes requested by other CDRC members, the Zoning Review Section approval is void, and we request copies of the revised tentative plat to verify that those changes do not affect any zoning requirements. Please be aware that the tentative plat may not be given final approval until the 14- day appeal period for the SCZ application has successfully expired.

Staff has reviewed submitted dated August 5, 2005, and offer the following corrections:


Rezoning case C9-04-04, condition number 9, reads as following:

Within the residential portion of the development, along all interior streets, streetscape landscaping shall include minimum 15 gallon canopy trees, located within the front yards of every other lot

Staff met with the applicant after the previous review was completed and needed corrections. Applicant indicated the following resubmittal would be corrected to meet rezoning condition number 9. The submittal included an attachment, which shows the required canopy tree on every other lot within all the interior streets. However, sheet number 5 of 5 includes a typical street cross section that verifies the proposed residential structures will be built abutting the front property line. Therefore it seems that the proposed site design with zero front yard setbacks is unable to comply with rezoning number 9. A rezoning condition may only be waived or modified by Mayor and Council. Please respond with which action you wish to take, to either modify rezoning condition or revise the site design to comply with rezoning condition as currently approved by Mayor and Council. A revised site design to consider would be to alter front yard setbacks from the current zero to 10 or 15 feet on every other lot to allow canopy trees or maybe at the front yard corner of two lots provide a building notch large enough to permit the growth of a canopy tree, on every other lot. Regardless of how the landscape plan is revised to meet rezoning condition # 9, the corrections need to be added to the actual landscape plan sheet and not as an attachment. The landscape plan sheet at the very least must include a typical lot layout of at least three lots showing the canopy tree locations and rezoning condition # 9 on sheet #1 needs to refer to this lot layout detail and which sheet it is locate within.

Rezoning case C9-04-04, condition number 14, reads as following:

All building elevations shall be designed using four-sided architecture. Detailed elevations of all buildings constructed on the site shall be provided at the time of development plan review.

As with previous comment, this condition requires all building elevations with four-sided architecture be submitted as part of this tentativeplat/development plan review. The letter submitted, addressing this issue indicates you will adhere to this condition. However, no building elevations were provided. As with prior comment, only the Mayor and Council can waive or modify rezoning conditions. Staff is unable to approve tentative plat/development plan until four-sided building elevations are submitted for all buildings as part of this review.

Rezoning case C9-04-04, condition number 17, reads as following:

Recreation and open space areas shall include drought tolerant native canopy trees, ground cover, shrubs, decomposed granite, shaded seating areas, grills and active recreation features. A minimum of two ramadas shall be provided in the common recreation areas.

The response on this rezoning requirement on this submittal indicates this condition has been satisfied on the approved landscape plan? This tentative plat/development plan review includes the landscape plan that shall be considered either approved or returned to corrections, based on the information provided in this submittal. The landscape plan included with this submittal does not provided confirmation that any of these requirements of the rezoning condition have been met. The landscape plan must identify by name and location where these amenities are located within the required common areas.
