05/05/2005 PATRICIA GILBERT ENGINEERING REVIEW Denied TO: Patricia Gehlen; CDRC Coordinator DATE: May 5, 2005

SUBJECT: Engineering review of the Flowers Condominium Final Plat. The activity number is S04-106.

SUMMARY: The Final Plat and CC&Rs were received by Engineering on April 22nd, 2005. Engineering has reviewed the received items and does not recommend approval of the Final Plat or the CC&Rs.

RESUBMITTAL REQUIRED: FP, CC&Rs, ASSURANCES, ORIGINAL AGREEMENT TO CONSTRUCT, ORIGINAL AMENDMENT TO CONSTRUCT, TRUST AGREEMENT.

The next submittal must address the following items:

GENERAL COMMENTS

1. Include the Assurance Package with the next Final Plat submittal. This package must include
the Third Party Trust, the Amendment to Trust, a copy of the Trust Agreement, a copy of the Deed, and a recent Title Report. The Final Plat will not be approved until the
Assurance Package is received and approved.

CC&Rs COMMENTS

1. A retention basin maintenance list was requested to be included in the CC&R's and was not included with the second submittal. Please be advised that this Office recommends including the Retention maintenance checklist in the CC & R's to allow the Home Owners Association access to it and facilitate their maintenance responsibilities. Submit revised copies of the CC & R's that specifically include a maintenance list of the drainage facilities. SMDDFM 14.03.2.

ASSURANCE COMMENTS

1. On the first page of the "Agreement to Construct Subdivision Improvements," under paragraph "A" the subdivision has been identified as Flowers Condominiums, Units 1 thur 16 and Common Area A (Retention Area), B (Pavement Area), C (Landscape and Walkway Area). The title block of the final plat titles Common Area B as "Vehicular Use Area." The title block on the final plat must be consistent with the title of the final plat in the assurances. Revise either the title block on the final plat or revise all the verbiage in the assurance package referencing the title of the final plat; exhibit "A" of the trust agreement (page seven) and on the "Amendment to Trust" title page, Section 1.

2. Include the Subdivision number on the title page of "Amendment to Trust." Include in the next submittal the original copy of the "Amendment to Trust."

3. Clarify the intent of the verbiage "To be placed in trust" and "To be known as" in Exhibit "A" of the Trust Agreement. The verbiage gives the impression that it is for the "Amendment to Trust." Please clarify and/or revise if necessary.

FINAL PLAT COMMENTS

1. The last sentence of the third paragraph under the section, "DEDICATION," addresses very specific utilities and it is not clear why. It is recommended to remove the last sentence of the third paragraph due to the fact public and all utility access is addressed in the beginning of the paragraph. If the sentence, "An Easement is hereby granted for the purpose of access, installation, replacing, repairing and maintenance of electrical meters, cable and conduits, which grouped electrical meters are attached to the exterior walls," is necessary, explain in detail in the response letter. Otherwise remove the verbiage for clarity. DS 2-03.6.3.B.2.b.

2. In the title block the word, "retention" is spelled wrong on all sheets. Revise as necessary.
05/06/2005 LIZA CASTILLO UTILITIES TUCSON ELECTRIC POWER Approv-Cond Tucson Electric Power Company (TEP) has reviewed the final plat submitted

FROM: David Rivera

PROJECT: S04-106
Flowers Condominiums
Final Plat

TRANSMITTAL: 05/14/05

DUE DATE: 05/06/05

COMMENTS:

1. Section 4.1.7.3, LUC, permits a maximum of one year from the date of application to obtain approval of a final plat plat. If, at the end of that time, the tentative plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this final plat is 01/09/06.

2. The square footage of the common areas must be labeled for each common area footprint or in a matrix table.

Previous Comment: Delineate clearly by hatch or line width and label all common areas. Include the square footage of the common areas. DS 2-03.6.4.C

3. The distance and bearings and curve data must labeled.

Previous Comment: All detention basins are to be shown in a surveyable and readily retraceable manner. DS 2-03.6.4.I

4. Although the following comment is not a Zoning discipline item I have made it as a follow up comment to the Engineering Reviewer comments related to tie points.

Indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Where a coordinate system has been established by the City Engineer or County Engineer, primary control points may be referenced thereto. At least one (1) corner of the subdivision will be tied by course and distance to a section corner, a quarter section corner, or an established City or County survey monument. The plat must include a description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat. DS 2-03.6.5.A

5. The following items are related to the drawing on sheet three of three. Please address as required.

a. The previous comment requested information for the common elements. I will discuss with Craig Gross the information provided on sheet one to see if this information is acceptable or do the volumes of the common elements have to be listed. Please call me by next Wednesday May 18th for resolution.

Previous comment: List and label all common areas or common elements such as floor, roof, and, wall volumes, which the homeowners association as a whole will be responsible for maintaining. Also label and list all exclusive common elements, which are reserved specifically to any of the proposed units.

If you have any questions about this transmittal, please call David Rivera, (520) 791-5608.
