Tucson Electric Power Company (TEP) has reviewed the final plat dated
January 8, 2005. TEP is unable to approve the plat at this time.

In order for this Company to approve the final plat, the following is
required, also as commented on our previous letter dated January 7, 2005.

* 10' x 10' easements are required at each of the transformer
locations. 6' x 6' easements are required at each of the pedestal
locations, or a 10' wide Public Utility Easement (PUE) along the front of
each lot which is dedicated to Public Utilities for utility purposes.
* The Dedication must include the granting of easements, as shown, to
all public utility companies for access, installation and maintenance.
Also, add the following to the dedication: "An easement is granted for the
purpose of access, installation, replacing, repairing and maintenance of
electrical meters, cable and conduits, which grouped electrical meters are
attached to the exterior walls."
* All Common Areas must be granted to Public Utility Companies for
access, installation and maintenance of utilities within the dedication on
the final plat.

SUMMARY: The Final Plat and CC&Rs were received by Engineering on January 10th, 2004. Engineering has reviewed the received items and does not recommend approval of the Final Plat or the CC&Rs.

The next submittal must address the following items:

GENERAL COMMENTS

1. Include the Assurance Package with the next Final Plat submittal. This package must include
the Third Party Trust, the Amendment to Trust, a copy of the Trust Agreement, a copy of the Deed, and a recent Title Report. The Final Plat will not be approved until the
Assurance Package is received and approved.


CC&Rs COMMENTS

1. Submit revised copies of the CC & R's that specifically address the maintenance of the drainage facilities. Add language in the text, which addresses the maintenance of the drainage structures in detail (i.e. what facilities to be inspected and maintained, how, when, by whom, the retention basin maintenance list, record keeping and repair decisions, etc). Please be advised that this Office recommends including the Retention maintenance checklist in the CC & R's to allow the Home Owners Association access to it and facilitate their maintenance responsibilities. SMDDFM 14.03.2.


FINAL PLAT COMMENTS

1. Add a legend that shows and describes all symbols used on the drawing either on the first sheet of the plat or the first sheet which contains all the information of the subdivision drawing. DS 2-03.6.1.L.

2. Place a north arrow on sheet 2 in the upper right corner with the scale of the drawing beneath the arrow. DS 2-03.6.1.I.

3. Add the following note, "Prior to issuance of any building permit, a Floodplain Use Permit is required for the development of Common Area B and C." DS 2-03.6.2.E.

4. Under the DEDICATION section, second paragraph, change the verbiage, "City of city" to "City of Tucson." DS 2-03.6.3.B.3.

5. The following title, "BENEFICIARY," must be included on the title page (sheet 1). DS 2-03.6.3.C.

6. Include the address of the beneficiary in the BENEFICARY section. DS 2-03.6.3.C.

7. The RECORDING DATA section must appear as shown in DS 2-03.6.3.D.

The Number and Fee line is not shown on the plat, revise as necessary. DS 2-03.6.3.D.

8. The third paragraph under the section, "DEDICATION," is not clear. The following verbiage is recommended to meet the requirements of DS 2-03.6.3.B.2.;

Comment elements shown on this are reserved for the private use and convenience of all owners within this subdivision and are granted as easements to the public and all utility companies for the purpose of access, installation, maintenance, and improvements of aboveground and underground utilities, private sewers, and drainage. Title to the land of all common elements shall be vested in an association of individual condominium owners as established by covenants, conditions, and restrictions recorded in docket _________ at page ________ in the office of the Pima County Recorder. The association will accept responsibility for the control, maintenance, and liability of the private sewers and common elements within this subdivision.

DS 2-03.6.3.B.2.

9. On sheet 2 two structures do not have the unit numbers identified. From comparing the tentative plat with the submitted final plat it appears that it is unit numbers 15 and 16. Revise. DS 2-03.6.4.B.

10. Each common area must clearly be defined. The boundaries of common area "B" and "C" is not clearly defined. The line weight are indistinguishable for common areas "B" and "C". Use a different type of line weight, a dashed line, etc, to clearly indicate common areas "B" and "C" on the plat. Include the different type of line weights in the legend. DS 2-03.6.4.C.

11. Provide the square footage for common area "A", "B" and "C". For common area A provide the square footage for each basin. DS 2-03.6.4.D.

12. Show the floodplain limits in a surveyable and readily re-traceable manner with frequent ties to intersecting lot lines. DS 2-03.6.4.F.

13. Show detention/retention areas in a surveyable and readily retraceable manner. DS 2-03.6.4.I.

14. Indicate a bearing or a right angle for the tie located adjacent to the southeast corner of the site. DS 2-03.6.5.A.

15. Provide recordation information the basis of bearing, general note 8. DS 2-03.6.5.C.1.a.

16. Label all boundary lines as to exact nature (measured or recorded). DS 2-03.6.5.C.2.

17. All boundary monumentation must be labeled as "found or "set." Fully describe and show all markings on found monuments. DS 2-03.6.5.C.4.

18. Indicate whether the distance and bearing between all monuments are measured or calculated. DS 2-03.6.5.C.5.

19. Are the bearings for the distances 17' and 199.43' indicated in the southeast corner the same as the bearing used for the distance of 625.34'? Please clarify.

20. Each building floor detail needs one bearing. Revise details found on sheet 3 to include a bearing for each floor.

21. At least one corner of the subdivision must be tied by course and distance to a section corner or a quarter section quarter. The buildings must be tied to permanent control monuments which must be tied to a corner of the subdivision which must be tied to a section corner. The survey must tie down exactly the location of the units being subdivided. The survey must be readily re-traceable. DS 2-03.6.5.A.

22. For the detail on sheet 3, units 1 through 14, 2nd floor, include a third cross section for the 5' by 7.33 area.

23. Patio area (limited common area) is not included when calculating the volume of each structure. Patio area is not an enclosed structure. Re-calculate the volume data for units 15 and 16.

The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


A private Sewer Service Agreement for the proposed number of residential units has been sent to your office. After three original Sewer Service Agreements have been signed by the Owner of Record, the three originals should be returned to Pima County Wastewater Management in order to satisfy the necessary requirements needed to approve the Mylars of the final plat.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat. The required revision(s) may be shown on the Mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Department of Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

COMMENTS:

1. Section 4.1.7.3, LUC, permits a maximum of one year from the date of application to obtain approval of a final plat plat. If, at the end of that time, the tentative plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this final plat is 01/09/06.

2. Please draw and label on the location map the City of Tucson / Pima County jurisdictional limits. For clarity of property location, label the street name Winstel Blvd. on the location map. DS 2-03.6.1.D.4

3. In the title block please revise the reference for Common Area B from pavement area to "Vehicular use area". Also please review and verify the correct legal description of the parcel to be subdivided by this plat. The legal description listed in the title block does not match the legal description per the Pima County Assessor's records. Please revise as required. DS 2-03.6.1.D.1 and .3

4. A legend, which shows and describes all symbols used on the drawing, will be placed on either the first sheet of the plat or the first sheet, which contains all, or part of the subdivision drawing.

5. Please revise general note 7 to state the following as noted in DS 2-03.6.2.H, "There will be no further division of lots without the expressed approval of the City of
Tucson."

6. Label buildings 15 and 16 and label the building heights of all buildings. DS 2-03.6.4.B

7. Delineate clearly by hatch or line width and label all common areas. Include the square footage of the common areas. DS 2-03.6.4.C

8. Show no-vehicular access where applicable. DS 2-03.6.4.H

9. All detention basins are to be shown in a surveyable and readily retraceable manner. DS 2-03.6.4.I

10. Although the following comment is not a Zoning discipline item I have made it as a follow up comment to the Engineering Reviewer comments related to tie points.

Indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Where a coordinate system has been established by the City Engineer or County Engineer, primary control points may be referenced thereto. At least one (1) corner of the subdivision will be tied by course and distance to a section corner, a quarter section corner, or an established City or County survey monument. The plat must include a description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat. DS 2-03.6.5.A

11. The following items are related to the drawing on sheet three of three. Please address as required.

a. Draw an additional cross section of the area dimensioned as 5'x 7.33'as depicted on the footprint of the second floor drawing for units 1 through 14.

b. Please clarify if the patio areas for units 15 and 16 are enclosed. If the patios are open but for the exclusive by tenants of buildings 15 and 16 the patio areas should be labeled as exclusive comment elements. The patio areas if open areas should lot be listed as building square footage or included in the volume calculation. Please revise the volume matrix table accordingly.

c. List and label all common areas or common elements such as floor, roof, and, wall volumes, which the homeowners association as a whole will be responsible for maintaining. Also label and list all exclusive common elements, which are reserved specifically to any of the proposed units.

12. Please address the following by separate response letter.


4.1.9.2 Disclosure Requirements.

Any subdivider who files a final plat for a condominium, cooperative, community apartment, townhouse, or mobile home park subdivision, whether for the purpose of new development or the subdivision of an existing development, shall submit a copy of a report on the physical condition of all buildings, structures, and other improvements to the property to be subdivided prior to approval of a final plat by the Mayor and Council. This report shall be provided by the subdivider to all prospective purchasers of units prior to execution of a binding contract of purchase. The report shall contain the following.

A. A statement of the estimated fees or assessments, if any, that the purchaser of a unit will pay, on a monthly and yearly basis, for at least a two (2) year period following purchase.
B. A report from a licensed pest control operator on each building or structure and each unit within the building or structure.
C. A statement of the unit's average monthly utility costs based on the preceding twelve (12) month period, where the subdivider has access to such utility cost data.
D. A report describing, to the best knowledge or estimate of the subdivider, the physical condition of elements of the structure, equipment, or appliances in a unit, the repair or replacement of which will be the responsibility of the purchaser. The report shall state the approximate date on which the element, equipment, or appliance was originally constructed or installed; the approximate date on which it was subsequently replaced or will likely require replacement; and the current estimated cost of replacement. This report shall not be construed to create any warranties, express or implied.
E. A report containing information to be obtained from the City Fire Department describing the extent to which the buildings and structures to be converted by the plat submitted by the subdivider deviate from applicable requirements of the Building Code, Tucson Code, Chapter 6, and the Fire Prevention Code, Tucson Code, Chapter 13, in the following specified areas of fire safety.

1. Accessibility of buildings and structures to fire-fighting equipment; and
2. Proximity and frequency of fire hydrants.
