This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. 2-06.4.9 - Information on Proposed Development The following information on the proposed project shall be shown on the drawing or added as notes. 1. COMMENT: 2-06.4.9.O – Per UDC TABLE 6.3-3.A: DIMENSIONAL STANDARDS FOR THE O-1, O-2, & O-3 ZONES, O-3 Zone, Nores Use to Nonres Zone the required perimeter yard setback from the proposed covered parking structures is 10' or ¾(H), (H) = Height of the proposed exterior building wall, the greater of the two dimensions applies. Perimeter yard setbacks are based on a measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A. As heights to the highest point of the wall were not provided Zoning cannot determine perimeter yard setback requirements from the covered parking structures to the east and west property. Per UDC Article 6.4.5.D.1 Along interior property lines, this type structure extend two feet into the perimeter yard, provided the side or rear yard is not reduced to less than three feet: Show the required perimeter yard setback from a point that shows the allowed 2’-0 overhang to the east and west property line. If these structures do not meet perimeter yard setback a neighbor’s setback waiver may be secured to reduce the setback. Per UDC Article 6.6.2.D An accessory structure that exceeds the allowable height of a wall within a perimeter yard and is detached from a principal structure shall comply with the perimeter yard width standards of the principal structure, except that the accessory structure may be built to a parcel line with the consent of the adjoining or, when separated by an alley, adjacent property owner(s). To secure this neighbor setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s): My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan. Signature: _____________________________ Date: _________________________________ If you are not able to secure the waiver a Design Development Option (DDO) must be submitted and approved to reduce the required setback, 2. COMMENT: 2-06.4.9.O – Per UDC 6.4.5.C.1 Within established areas, the minimum required front street perimeter yard is 20 feet or one and one-half the height of the proposed wall (H), measured from the street property line. Per UDC Article 6.4.5.D.3 Architectural features that are part of a solar energy system may project up to four feet into required front perimeter yards. Provide street perimeter yard setback dimension from a point that shows the allowed 4’-0 overhang to the front street property line.
