03/31/2020 | SBEASLE1 | OTHER AGENCIES | TUCSON AIRPORT AUTHORITY | Reqs Change | March 23, 2020 RE: DP20-0039 / SITE/GRADING/SWPPP - Waterwalk at the Bridges, multi-story hotel / 1st Submittal, Received February 26, 2020 Thank you for the opportunity to comment on DP20-0039, Waterwalk at the Bridges, multi-story hotel, 1st Submittal, a development package application for an approximately 2.6 acre site, located west of the intersection of East Tucson Marketplace Boulevard and South Park Avenue. The property is zoned Planned Area Development 15 (PAD-15), with the proposed development being a traveler’s accommodation and lodging. This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace. The Tucson Airport Authority conditionally approves the subject request contingent upon the following condition of approval, as noted below. This condition shall be identified in the general notes of the revised development plan. Condition of approval: According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this project area is located in proximity to a navigation facility and could impact navigation signal reception. As the project site develops, every project applicant shall file FAA Form 7460 with the FAA at least 45 days before construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA), provides the project applicant with written communication that filing FAA Form 7460 is not required. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp” Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the applicant add the following note into the general notes of the revised development plan. This project is located approximately 4 miles north of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport. This proposed note would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through the property owner recording the Avigation Easement. The Tucson Airport Authority believes the proposed note helps to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson – Regional and Global Positioning policy 4 (RG-4). "That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided. The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder’s Office. Once the Avigation Easement is recorded please send a complete copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below. Scott Robidoux , Senior Airport Planner Tucson Airport Authority 7250 South Tucson Boulevard Suite 300 Tucson, AZ 85756” Please do not hesitate to contact me if you have any questions or concerns regarding this comment letter. Please send me a copy of the recorded Avigation Easement document. Details regarding the Avigation Easement document are contained on page B-7 of the PAD Amendment for Sub-Areas B (April 2018). |
