The property is zoned Commercial 1 (C-1), with the proposed development being automotive - minor service and repair. This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace. The Tucson Airport Authority conditionally approves the subject request contingent upon the following condition of approval, as noted below. This condition shall be identified in the general notes of the revised development plan. Condition of approval: 1. "According to the FAA Notice Criteria Tool, this project is located in proximity to a navigation facility and could impact navigation signal reception. The applicant shall file Form 7460 with the FAA at least 45 days before construction activities begin for the project. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes used which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp" Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the City of Tucson consider requiring the applicant to add the following note into the general notes of the revised development plans. This project is located approximately 1½ miles northwest of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport. The proposed note would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through requiring the property owner to record the Avigation Easement. The Tucson Airport Authority believes the proposed note helps to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson - Regional and Global Positioning policy 4 (RG-4). 1. "That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided." The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder's Office. This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is February 20, 2020. 1. 2-06.4.1 - Provide email address for the Owner/Developer in the contact information on the cover sheet. 2. 2-06.4.2.B - Provide a brief legal description and a statement as to whether the project is a resubdivision in the title block. 3. 2-06.4.3 - Provide the assigned case number (DP19-0042) adjacent to the title block. 4. 2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses. Correct zoning note 4 on sheet one. The proposed use is Automotive - Minor Service and Repair (Auto Washing Self-Service), subject to use-specific standards 4.9.4.F.2, .3, .4, & .5 and 4.9.13.O 5. 2-06.4.7.A.6 - Provide additional information regarding the approved Special Exception with submittal documents. A minor change to the Preliminary Development Plan was requested and approved by Planning and Development Services. Provide the original exhibit that was approved with the letter dated 10/29/18 in order to verify current submittal aligns with approved minor change. 6. 2-06.4.7.A.8.c - Provide a percentage of building, lot area, or vehicular use area expansion. If the building(s) or lot area have been previously expanded, those calculations shall be included. Provide total square footage, including the previous wand areas and the new vacuum areas in the total for the site. If this site is in reality a reduction, include those calculations as well for record-keeping purposes. 7. 2-06.4.8.B - Verify all easements are drawn on the plan. The recordation information, location, width, and purpose of all easements on site will be stated. Blanket easements should be listed in the notes, together with recordation data and their proposed status. Should an easement not be in use and be proposed for vacation or have been abandoned, so indicate. However, should the easement be in conflict with any proposed building location, vacation of the easement shall occur prior to approval of plan unless written permission from easement holder(s) is provided. 8. 2-06.4.8.C - The following information regarding existing private or public right-of-way adjacent to or within the site shall be provided: the name, right-of-way width, recordation data, type and dimensioned width of paving, curbs, curb cuts, and sidewalks. All dimensions must be included adjacent to the site and across any right-of-way. 9. 2-06.4.9.L - All proposed easements (utility, sewer, drainage, access, etc.) are to be dimensioned and labeled as to their purposes and whether they will be public or private. The easements may have to be recorded and the recordation information added to the development package prior to approval. Verify no easements are proposed. 10. 2-06.4.9.O - All applicable building setback lines, such as erosion hazard, floodplain detention/retention basins, and zoning, including sight visibility triangles, will be shown. Correct building setbacks on sheet 1. MS&R setbacks are 21' or the height of the structure, whichever is greater. Indicate setback location, as measured from back of future curb, on sheet 2. 11. 2-06.4.9.U - Indicate graphically, where possible, compliance with conditions of rezoning. 12. 2-06.4.9.W - Indicate the locations and types of proposed signs (wall, free-standing, pedestal) to assure there are no conflicts with other requirements and that minimal locational requirements can be met. Indicate if there are any existing billboards on site. Compliance to the Sign Code, Chapter 3 of the Tucson Code, is required.
