Dear Ms. Beasley,
Thank you for the opportunity to comment on DP19-0034, TEP Kino Substation, a development package application for an approximately 4.9 acre site, located southeast of the intersection of South Kino Parkway and East 36th Street. The property is zoned Planned Area Development 15 (PAD-15), with the proposed development being a utility substation.
This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.
The Tucson Airport Authority conditionally approves the subject request contingent upon the following condition of approval, as noted below. This condition shall be identified in the general notes of the revised development plan.
Condition of approval:
1. "According to the FAA Notice Criteria Tool, this project is located in proximity to a navigation facility and could impact navigation signal reception. The applicant shall file Form 7460 with the FAA at least 45 days before vertical construction activities begin for the project. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes used which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp"
Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the City of Tucson consider requiring the applicant to add the following note into the general notes of the revised development plans. This project is located approximately 4 miles north of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport.
The proposed note would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through requiring the property owner to record the Avigation Easement. The Tucson Airport Authority believes the proposed note helps to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson - Regional and Global Positioning policy 4 (RG-4).
1. "That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided."
The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder's Office. Once the Avigation Easement is recorded please send a complete copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

3. A private improvement agreement may be required if the extent of new curbing will result in impacts to existing drainage patterns. Otherwise an excavation permit will suffice.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is February 11, 2020.


2-06.3.5 - A three-inch by five-inch space shall be reserved in the lower right quadrant of each sheet for an approval stamp.

1. COMMENT: Assure that there is an open space in the lower right corner next to the title block on each sheet to accommodate the Digital PDSD stamp.


CONTENT REQUIREMENTS

2-06.4.1 - The name, mailing and email addresses, and phone number of the primary property owner of the site, the developer of the project, registrant(s), and other person(s), firm(s), or organization(s) that prepared the development package documents shall be provided on the right half of the cover sheet. The applicable registration or license number shall be provided if prepared by or with the assistance of a registered professional, such as a surveyor, architect, landscape architect, or engineer. All sealing shall be consistent with Arizona Board of Technical Registration guidelines.

2. COMMENT: List on the cover sheet the email addresses for the Owner/developer, LS Architect and Engineer.

2-06.4.2 - The title block shall include the following information and be provided on each sheet:

2-06.4.2.B - A brief legal description and a statement as to whether the project is a re-subdivision are to be provided. On re-subdivisions, provide the recording information of the existing subdivision plat;

3. COMMENT: Clarify if the sub-station parcel is to be split from Block 13 or is it a lease area etc. (Be aware that additional comments may be forthcoming on this item based on the response.)


2-06.4.3 - The administrative street address and relevant case numbers (development package document, subdivision, rezoning, board of adjustment, DDO, MDR, DSMR, overlay, etc.) shall be provided adjacent to the title block on each sheet.

4. COMMENT: Provide the development package case number, DP19-0034, adjacent to the title block on each sheet.


2-06.4.6 - If the project is located within the boundaries of a Planned Area Development (PAD) zone, include a reduced-scale map of the PAD on the first sheet, indicating the location of the portion being developed.

5. COMMENT: Include the PAD map as noted by the standard above.


2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses.

6. COMMENT: The use note should state Use as noted in the PAD or the UDC - "Utilities Use Group: Distribution System". Revise the use note on sheet 2.


2-06.4.7.A.7 - If the property is part of a subdivision plat that is being reviewed or has been recorded, provide the case number in the lower right corner of each sheet. As a general note, indicate whether the project is part of a Flexible Lot Development (FLD), condominium, or another similar type project.

7. COMMENT: As noted in comment 3 above, clarify if Block 13 is to be subdivided?


2-06.4.9.E - Proposed land splits or existing lot lines shall be drawn on the plan with dimensions and the identification number and approximate square footage of each lot. (Please be aware that, if land division occurs and the number of lots falls within the definition of subdivision, a subdivision plat is required.) Land splits require a separate permit and review.

8. COMMENT: Same as comment 3 and 7 above.


2-06.4.9.H.2 - Show future and existing sight visibility triangles. On a designated MS&R street, the sight visibility triangles are based on the MS&R cross-section.

9. COMMENT: Site keynote information is missing from the Site Keynotes legend on sheet 3.


2-06.4.9.O - All applicable building setback lines, such as erosion hazard, floodplain detention/retention basins, and zoning, including sight visibility triangles, will be shown.

10. COMMENT: Clarify if there are any unmanned enclosed structures on the site. If so label the building setback to the structures.


2-06.4.9.Q - Provide the square footage and the height of each commercial, industrial, or business structure and the specific use proposed within the footprint of the building(s).

11. COMMENT: Clarify if there are any unmanned enclosed structures on the site. If so label the building SF and Heights within the footprint of the structures.


12. COMMENT: Respond to the following comments related to the Amendment conditions: Condition 2 states that LED Bollards will be installed along the west frontage of the development. Provide documentation from PDSD that states that the bollards can be deferred to Pima Count for installation.

Include elevations drawings of the 10 foot tall screen wall indicating the design elements that will be used as noted by the Amendment condition 7 and as noted in condition 9.
