Dear Ms. Beasley,
Thank you for the opportunity to comment on DP18-0250, Skyline Labs; 2nd Submittal, a development package application for an approximately 3.4 acre site, located west of the intersection of East Science Park Drive and South Kolb Road. The property is zoned Industrial 2 (I-2) and the proposed development is a new research and development facility.

This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.

The Tucson Airport Authority has reviewed the applicant's second submittal. The Tucson Airport Authority requests the applicant to revise the FAA Notes contained on Sheet 4 of 9 within the plan set and that the applicant proceed with recording the signed Avigation Easement document with the Pima County Recorder.

Note #1 shall be revised to be the following;
1. "According to the FAA Notice Criteria Tool, this project is located in proximity to a navigation facility and could impact navigation signal reception. The applicant shall file Form 7460 with the FAA at least 45 days before construction activities begin for the project. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes used which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp"

Note #2 shall be revised to be the following;
2. "That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided."

The Tucson Airport Authority confirms receiving a signed copy of the Avigation Easement document. Please proceed with recording the Avigation Easement with the Pima County Recorder and send a copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year expiration date is October 5, 2019.

1. Previous comment #1. The same scale shall be used for all sheets within the set.

2. Previous comment #2. The scale information on the landscape and irrigation plan sheets did not print/rasterize correctly on the sheets.

3. Previous comment #3. A lot of the text for the notes on the landscape and irrigation sheets did not print/rasterize correctly on the PDF sheets. Correct the text as required.

4. Previous comment #4. For consistency, assure that the title blocks on all sheets match and include the same information. Text in the title block did not print/rasterize correctly on all sheets.

5. Previous comment #11. Add a general note that states that this development has been designed to comply with UDC Section 5.4 Major Streets and Routes Setback Requirements. Correct the typo in General Note 14. It should read "5.4".

6. Previous comment #14 not fully addressed. List the recording data for Kolb Road.

7. Previous comment #23 not fully addressed. Label within the building footprint the use proposed in each building. Include the proposed use within all buildings on the site, including the proposed building.

8. When comments on this transmittal have been addressed, an over-the-counter can be scheduled. Please contact me to set-up a time.

1) Previous comment 11. Building C has a large roll up door to provide vehicular access within the building. A vehicle use area is required to connect building C to the private street. Provide a vehicular use area that meets the requirements of UDC section 7.4.6 for the area adjacent to and around building "C". Per COT Unified Development Code (UDC) section 7.4.6.H, provide a barrier, such as curbing to prevent vehicles from driving onto the unimproved portions of the sit. Add necessary storm water facilities based on the increase in impervious area. Provide top/bottom spot grades for all proposed water harvesting areas to show that the 6" effective ponding depth is maintained
