Oury Street - An FLD Subdivision (2 Dwellings) Development Package (1st Review) DP18-0035 TRANSMITTAL DATE: March 13, 2018 DUE DATE: March 14, 2018 COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed. Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is February 08, 2019. SECTION 2-06.0.0: DEVELOPMENT PACKAGE (TENTATIVE PLATS AND SITE PLANS) Section CONTENT REQUIREMENTS 2-06.4.1 - The name, mailing and email addresses, and phone number of the primary property owner of the site, the developer of the project, registrant(s), and other person(s), firm(s), or organization(s) that prepared the development package documents shall be provided on the right half of the cover sheet. The applicable registration or license number shall be provided if prepared by or with the assistance of a registered professional, such as a surveyor, architect, landscape architect, or engineer. All sealing shall be consistent with Arizona Board of Technical Registration guidelines. 1. COMMENT: List the Owner's Phone number and email address on the title sheet. 2-06.4.2 - The title block shall include the following information and be provided on each sheet: 2-06.4.2.B - A brief legal description and a statement as to whether the project is a re-subdivision are to be provided. On re-subdivisions, provide the recording information of the existing subdivision plat; 2. COMMENT: The legal description does not appear to match the actual legal description of the lot. This lot appears to be in the same configuration as was recorded in Map and Plat 3/26. The legal description in the title block describes the lot as a portion of lot 2. Revise as required. 2-06.4.2.C - The number of proposed lots and common areas are to be noted. If the subdivision is a Flexible Lot Development (FLD), a condominium, or a similar type of residential subdivision utilizing special provisions of the UDC, it shall be so noted; 3. COMMENT: List the within the title block the number of proposed lots. 2-06.4.3 - The administrative street address and relevant case numbers (development package document, subdivision, rezoning, board of adjustment, DDO, MDR, DSMR, overlay, etc.) shall be provided adjacent to the title block on each sheet. 4. COMMENT: Provide the development package case number, DP18-0035, adjacent to the title block on each sheet. 2-06.4.4 - The project-location map to be located on the first sheet of the development package in the upper right corner, shall cover approximately one square mile, be drawn at a minimum scale of three inch equals one mile, and provide the following information. 2-06.4.4.B - Identify major streets and regional watercourses within the square mile area and all streets that abut the subject property; and, 5. COMMENT: Label Main Avenue and 6th Street on the location map. 2-06.4.7 - General Notes The following general notes are required. Additional notes specific to each plan are required where applicable. 2-06.4.7.A - Zoning and Land Use Notes 2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses. 6. COMMENT: The proposed use note needs to be revised to state that the project is for detached SFR development utilizing the FLD 8.7.3 Alt. A. The use specific standards do not apply in this case. 2-06.4.7.A.5 - On residential projects, list the total number of units/lots proposed. 7. COMMENT: List as a general note the number of proposed units. 2-06.4.7.A.6 - If a plan or plat is prepared in conjunction with other applications or overlays or the parcel being developed is subject to conditions of an application processed previously, additional information must be added to the plan. Such applications and overlays include, but are not limited to: annexations; rezonings; special exceptions; Board of Adjustment variances; Design Development Options; Technical Standard Modification Request; overlays (Airport Environs Zone, Environmental Resource Zone, Gateway Corridor Zone, Hillside Development Zone, Historic Preservation Zone, Major Streets and Routes, Rio Nuevo District, Scenic Corridor Zone, WASH); Modification of Development Regulations through the Downtown Area Infill Incentive District or Rio Nuevo District; Downtown Heritage Incentive Zone; or, Design Review Board. Provide the following information on the plan. 2-06.4.7.A.6.a - List additional applications and overlays, by case number (if applicable), in lower right corner of each sheet. As a general note provide the type of application processed or overlays applicable, a statement that the project meets the criteria/conditions of the additional application or overlay, the case number, date of approval, what was approved, and the conditions of approval, if any. 8. COMMENT: If additional application related to this development are required such as overlay or modifications list the case type as a general note(s), date of approval, modifications or conditions of approval and list the case numbers as reference next to the title block of all sheets. 2-06.4.7.A.6.b - If there is more than one lot within the site, the note should specify which lots are affected by the additional applications or overlay zones. 9. COMMENT: If applicable add the information as noted by the standard above. 2-06.4.7.A.7 - If the property is part of a subdivision plat that is being reviewed or has been recorded, provide the case number in the lower right corner of each sheet. As a general note, indicate whether the project is part of a Flexible Lot Development (FLD), condominium, or another similar type project. 10. COMMENT: Include as a general note that this is an FLD Development. 2-06.4.8 - Existing Site Conditions 2-06.4.8.B - All easements shall be drawn on the plan. The recordation information, location, width, and purpose of all easements on site will be stated. Blanket easements should be listed in the notes, together with recordation data and their proposed status. Should an easement not be in use and be proposed for vacation or have been abandoned, so indicate. However, should the easement be in conflict with any proposed building location, vacation of the easement shall occur prior to approval of plan unless written permission from easement holder(s) is provided. 11. COMMENT: On Sheet 5, a note related to a "New utility and access easement per this DP." Clarify when the easement will be recorded. Per an email between Steve Shields and Matt Stuart the easements will have to be in place prior to Lot Split Approval. This means that the easement should be recorded and a sequence number obtained through the Pima County Recorder's office prior to approval of the DP or the note needs to reflect that the easement will be recorded by separate instrument and listed on the Lot split drawing. 2-06.4.9 - Information on Proposed Development The following information on the proposed project shall be shown on the drawing or added as notes. 2-06.4.9.C - If the project has common areas, label each common area individually with a separate letter designation. Enclose with a solid line each common area, private street, etc., that will have separate restrictions, a separate homeowners' association, or any common area that is separated by a public right-of-way. 12. COMMENT: Keynote 9 has been labeled on the symbol of the drawing on sheet 3. Label the pavement/vehicular use area with the correct keynote number. 2-06.4.9.H.5.a - Show all motor vehicle off-street parking spaces provided, fully dimensioned. As a note, provide calculations on the number of spaces required (include the ratio used) and the number provided, including the number of spaces required and provided for the physically disabled. The drawing should indicate parking space locations for the physically disabled. A typical parking space detail shall be provided for both standard parking spaces and those for the physically disabled. For information on parking requirements for the physically disabled, refer to adopted building and accessibility codes of the City of Tucson. Design criteria for parking spaces and access are located in Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC. 13. COMMENT: Revise the parking calculations accordingly. Four spaces are required for the residential and one visitor parking space is required for a total of 8 spaces. 2-06.4.9.O - All applicable building setback lines, such as erosion hazard, floodplain detention/retention basins, and zoning, including sight visibility triangles, will be shown. 14. COMMENT: The proposed building setbacks along Oury Street, and the east and south boundary property lines will require approval through a DDO process. The minimum building setback along the east and south property lines is based on the greatest of 6 feet or 2/3rds the height; based on a height of 16 feet from grade the minimum building setback is 10'-8" from the east and south property lines. The developer is proposing a 3.9 foot setback along the east property line and 3 foot setback along the south property line. The building setback for the building on "Lot A" along the Oury Street frontage is based on the greatest of 20' or 1.5 times the height measured from the street property line. Based on a 16 foot building height from grade; the building setback must be 24 feet from the street property line. The plan did not include a building setback to the street property line. (Developing area setbacks do not apply for this project.) 2-06.5.0 FLEXIBLE LOT DEVELOPMENT (FLD - ADDITIONAL REQUIREMENTS) 2-06.5.2.A - Provide, by note on the plat, the developable area calculation for the entire FLD; and, 15. COMMENT: Provide by note the developable are calculation as noted by the standard above. 2-06.5.2.B - Show the maximum developable area of each lot (i.e., building footprint). 16. COMMENT: Provide the information as noted by the standard above. 2-06.5.3 Additional Information The following are required in addition to the requirements of the tentative plat or site plan, whichever is applicable: 2-06.5.3.A. Reduced Perimeter Yards Street perimeter yards along interior street rights-of-way and perimeter yards between interior lots may be modified in accordance with Section 8.7.3.L, Perimeter Yards on Interior Lots, of the UDC. Applicants requesting a perimeter yard reduction must indicate what the required and reduced perimeter yards are and their locations. Applicants requesting a reduced street perimeter yard must provide a written description of how the reduced yard will enhance the architectural design or the vehicular circulation in the FLD and submit a transportation statement, or if required by the Department of Transportation, a traffic impact analysis; 17. COMMENT: Add to general note 16 that the interior setbacks may be reduced for setbacks along interior lot lines to the extent permitted by the City's adopted Building Codes. 2-06.5.3.C - Functional Open Space Delineate the boundaries of the proposed functional open space on the tentative plat or site plan, whichever is applicable. Provide, by note on the plat, the required and proposed functional open space calculations; 18. COMMENT: The functional open space must be under the guides of a HOA. It does not appear that an HOA is proposed for this development and the functional open space has to be accessible to all residents of the subdivision. Proposal for FOS within the individual lot does not meet the requirement. 2-06.5.3.D - Building Elevations Provide dimensioned building elevations of all proposed units. The elevations can be preliminary drawings. The model home construction plans will be used to determine exact setbacks and screening requirements at the time of application for building permits; 19. COMMENT: Provide the elevation drawings as noted by the standard above. 2-06.5.3.G.1 - Provide three copies of the Covenants, Conditions, and Restrictions (CC&Rs) regarding the homeowner's association's responsibility for the ownership and maintenance of commonly-owned property. 20. COMMENT: If applicable provide the documents. 21. COMMENT: For clarification; Per UDC article 8 section 8.7.3.P - FLD Submittal, Review, and Decision; An FLD shall be prepared, processed, and have a tentative and final plat or site plan, whichever is applicable, approved prior to issuance of a building permit with the following exception. Model homes may be authorized for construction prior to recordation of the final plat in accordance with Section 8.6.4, Permits for Model Homes. (Site Plans are for FLD Multi-family development.) 22. COMMENT: 2-06.3.5 - Remove Development Package PDSD approval stamp on all sheets. Reserve a three-inch by five-inch space in the lower right quadrant of each sheet for an approval stamp. The approval stamp will be applied electronically.
