Thank you for the opportunity to comment on DP16-0238, Downtown Clifton Expansion; 1st Submittal, a Development Package application for an approximately 0.71 acre site located northeast of East 16th Street and South Stone Avenue. The proposed land use is commercial.

This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.

The applicant shall file Form 7460 with the FAA at least 45 days before any construction activity is to begin. Any cranes used for the project must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp.

The Tucson Airport Authority conditionally approves the subject request contingent upon the following condition of approval, as noted below. This condition should be identified in the general notes of the approved development plan.

Conditions of approval:

"That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement prior to the subdivision process which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The content of such documents shall be according to the form and instructions provided."

The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. The Avigation Easement shall be recorded with the Pima County Recorder's Office. SUMMARY: Engineering Division of Planning and Development Services Department has received and reviewed the proposed Development Plan Package. The following items need to be addressed:
1) Per AM 2-06.4.3 please add the case number (DP16-0238).
2) Per UDC 7.14.4, Section 2.3.1.1B please include the case number on the drainage report cover.
3) The project description in the drainage report contains a typo where is describes an expansion of an existing "mote" facility. Please update accordingly.
4) Per AM 2-06.4.9N general note 23 on sheet 1 and general paving and grading note 19 on sheet 2 should reflect water harvesting in all landscape areas per the detention/retention section of the drainage report. Please note that an exception is available for areas deemed unsuitable for water harvesting near building subject to geotechnical report recommendations. This should be noted in the drainage report so the plans match the drainage report recommendations. Please submit the geotechnical report mentioned in Earthwork/material testing+ certification note 1, as found on sheet 2 for a compliance check against the plans. See TSM 2-01.4.1D for requirements.
5) Due to the expanded use, curb returns may be required to replace the curb cut on sheet 3 per TSM 10-01.3.2D based on the ADT of the now combined use. Please provide the ADT in the response letter and the appropriate modifications if required or TSMR/IID/Variance as applicable.
6) Per UDC 7.6.6C please provide a curb cut at the south side of the western entryway to allow drainage from hardscape to be routed to the required water harvesting area along Stone on the western side of the sight.
7) Per Tucson Code Chapter 25-40(b) the expanded use of this site may trigger compliance with the 5' separation requirement between the curb cut/curb returns and the light pole. A Variance or IID may be warranted in this case.
8) Keynote 14 is calling out "drivable grass" south of the western entryway on sheet 3. Please provide a detail/spec that shows compliance with UDC 7.4.6I for surfacing requirements. Please call to discuss this material with PDSD Engineering staff if an exception through the IID is going to be requested.
9) Keynote 22 is calling out a new trash enclosure that per TSM 8-01.5.3G should be realigned to conform with the requirements of figures 1 or 4 of TSM 10. Please contact Thomas Ryan at ES (837-3713) for staff support for a TSMR/variance/IID exception.
10) Keynote 23 reflects a new site amenity. Per AM 2-06.3.10 please identify the material represented by the hatching that keynote 23 is superimposed over.
11) The leader line from a keynote 16 callout on the south side of the parking by the south side of the western entry appears like it may be better identified with keynote 12. No curb stop linework appears at this location as would be expected by a keynote 16 callout.
12) Per UDC 7.6.6C there are a few depressed 6" water harvesting areas on the west side of the site on sheet 4 where hardscape surfaces should be routed to these areas.
13) There are three locations on sheet 4 where the slopes to not match the proposed conditions watershed map contained in the drainage report. Per AM 2-06.4.9N please update these area accordingly. There is an area between the northwestern two buildings where a portion of PWS2 is draining north into PWS1 instead of west towards South Stone. There is an area between the northeastern two buildings where a portion of PWS4 is draining west into PWS1 instead of south towards PWS3. There is an area between the southwestern two buildings where a portion of PWS3 is draining north into PWS 2 instead of south into east 16th Street. Please note that it is acceptable to update the drainage report if this drainage schematic is the intended design.
14) Per TSM 2-01.4.1C3 and AM2-06.4.9N4 please show ridge lines/high points on sheet 4 for grading detail.
15) There is an unidentified water meter on sheet 5 that is south/adjacent to the water meter called out by water keynote 3. Please update accordingly.
16) Per TSM 2-01.4.1C6 the concrete compressive strength called out in detail F6 may need to be updated depending on the requirements of the geotechnical report to be submitted with the 2nd submittal.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is December 28, 2017.

CONTENT REQUIREMENTS

1. 2-06.4.3 - Provide the development package case number, DP16-0238, adjacent to the title block on all sheets.

2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

2-06.4.7.A - Zoning and Land Use Notes

2. 2-06.4.7.A.6.a - As an IID is required provide the IID case number adjacent to the title block on all sheets. As a general note state the IID case number, date of approval, what was modified, and if applicable any conditions of approval.

2-06.4.8 - Existing Site Conditions
The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided.

3. 2-06.4.8.A - As the site is made up of three (3) parcels, 117-14-2140, 117-14-2180 & 117-14-2190 a lot combination is required. Provide a copy of the approved Pima County Combo Request form with your next submittal.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

4. 2-06.4.9.H.5 The proposed surfacing called out under Keynote 14 will need to be approved by the PDSD City Engineer, see UDC Article 7.4.6.I.d.

5. 2-06.4.9.H.5.a - For the three (3) vehicle parking spaces shown on site just south of the entrance access lane off of Stone, provide a "C" space depth dimension and show the vehicle overhang and provide a dimension.

6. 2-06.4.9.H.5.a - The vehicle parking space calculation shows 39 spaces required, 26 spaces are provided on site. Per UDC Article 5.12.9.C.2.c.(3) 5 vehicle parking spaces are proposed within the right-of-way along Stone Avenue and per UDC Article 5.12.9.C.2.a a reduction of 8 vehicle parking spaces, 20.5%, is proposed. An IID is required and must be approved prior to approval of this development package.

7. 2-06.4.9.H.5.d - The short term bicycle parking space calculation on sheet 1 states that space for four (4) bicycles is provided. Sheet 3, Keynote 24 only points to one (1) rack and detail H sheet 6 only shows one (1) rack for a total of two (2) bicycle spaces provided.

8. 2-06.4.9.H.5 Provide a dimension between the long term bicycle locker and the rack to the south, see UDC Article 7.4.9.B.2.g

9. 2-06.4.9.J - It appears that there may be some clarification needed how to read the MS&R Map. I have reached out the Andrew McGovern, TDOT, to attempt to clarify if a future ROW is applicable to this site for Stone Ave. Clarify what the Future Right-Of-Way detail sheet 3 is for.

10. 2-06.4.9.O - Sheet 1 General Note 18, all required street perimeter yard setbacks are not correct. Based on the definition of Established Area Setback, A term used to describe the required building setback from a street applicable as follows. When street frontage of the property is on a street other than one designated a major street or route by the adopted Major Streets and Routes (MS&R) Plan a Zoning Administrator determination when a site is bordered by a street that is designated on the COT MS&R Plan than all streets that border the site will use developing area street perimeter yard setbacks. Based on wall heights of less than 21' all required street perimeter yards should be listed as 21'.

11. 2-06.4.9.O - Until comment 8 is addressed the street perimeter yard setback requirements along Stone Avenue cannot be verified.

12. 2-06.4.9.O - Provide a street perimeter yard setback dimension for the center building along 16th Street.

13. 2-06.4.9.O - Provide a street perimeter yard setback dimension for the southeast building to Russell Ave.

14. 2-06.4.9.O - There is a new wall/fence called out under keynote 26. Provide the proposed height for this wall. Until the height is provided requirements for perimeter yard setbacks cannot be determined.

15. 2-06.4.9.O - Until comment 9 has been addressed the proposed street perimeter yard setbacks to Stone Avenue cannot be verified.

16. 2-06.4.9.O - Per UDC TABLE 6.4.5.C-I, ADT of 1,000 or greater, the required Street perimeter yard from the proposed buildings to 16th Street is 21' or the height of the proposed exterior building wall, whichever is greatest, measured from the back of curb. Based on a proposed exterior wall height of 20.16' The required street perimeter yard setback to 16th Street is 21', proposed worst cast street perimeter yard setback to 16th Street is 12.1'. Per UDC Article 5.12.9.C.1.b. the perimeter yard maybe reduced. An IID is required and must be approved prior to approval of this development package.

17. 2-06.4.9.O - Per UDC TABLE 6.4.5.C-I, ADT of 1,000 or greater, the required Street perimeter yard from the proposed buildings Russell Avenue is 21' or the height of the proposed exterior building wall, whichever is greatest, measured from the nearest edge of travel lane. Based on a proposed exterior wall height of 20.16' The required street perimeter yard setback to Russell Avenue is 21', proposed worst cast street perimeter yard setback to Russell Avenue is 12.4'. Per UDC Article 5.12.9.C.1.b. the perimeter yard maybe reduced. An IID is required and must be approved prior to approval of this development package.

18. 2-06.4.9.R - Provide sidewalk width dimensions for all proposed sidewalks, see blue highlight sheet .

19. 2-06.4.9.R - Per TSM Section 7-01.4.1.A At least one sidewalk is required to a project from each street on which the project has frontage, unless there is no vehicular access from a street because of a physical barrier, such as a drainageway or an unbroken security barrier (e.g., a wall or fence). Provide a sidewalk to 16th Street.

20. 2-06.4.9.R - Clearly show the required accessible route from a street to all buildings and the accessible vehicle parking spaces. Demonstrate that all running and cross slopes are met per the ICC.

1. The proposed improvements in the right of way are acceptable. However the following will need to be modified on the plan or acknowledged.

2. Driveway apron acceptable. TDOT will support the driveway aprons instead of curb returns.

3. At time of construction a private improvement agreement (PIA) will be required due to new curb and improvements along S Russell Av.

4. A 5 foot separation is required between a curb cut and a light pole for new driveway along Stone Ave. Tucson city code Chapter 25 39 (b). It seems existing light pole will need to be moved. TDOT will not support a waiver for this requirement.

5. Key note 25 page 3 of 11. New wall/fence seems to be along property line. Ensure footer does not encroach onto right of way.

6. Keynote 15. Concrete pad for trash pickup should extend entire width of Russel Av.

7. Ensure all sidewalk and pedestrian ramps meet current ADA requirements. Improvements to any substandard sidewalk i.e. buckling or cracked must be replaced.

Provide a note on the plans requiring the installation of a backwater valve when future plumbing activities take place. Reference: Section 715.1, IPC 2012, as amended by the City of Tucson.
01/30/2017 AHINES2 COT NON-DSD ENVIRONMENTAL SERVICES Approved The City of Tucson - Environmental Services Department has completed our review of the Development Package for the Downtown Clifton Expansion project. In addition, I visited the property to inspect the proposed enclosure location.

The waste generation calculations were reviewed and found to be correct.

Due to the sites location within the Infill Incentive District, Cypress Civil Development is requesting the following exemptions from Section 8 of the Technical Standards Manual:

•An exemption is being requested for Section 5.3. A. which requires that service access shall be from within the development. Service access is proposed along S. Russell Avenue on the east side of the site.
•An exemption is being requested for Section 5.3. G. which states that when service access cannot be provided from within the development, the enclosure shall be located such that service is from the adjacent public right of way with a 45 degree or 30 degree angle of approach. The enclosure is parallel to S. Russell Avenue and the 45 degree or 30 degree offset is not provided.

One two cubic yard metal container is proposed for refuse and one two cubic yard metal container is proposed for recycle materials. It is proposed that the containers will be rolled out of the enclosure and placed along S. Russell Avenue for pick-up.

Section 5.3. A. Given the proposed building development on the subject site, the only possible location for the container enclosure within the development would be on the parking area on the north side of the site. A total of 29 parking spaces are required for the proposed development. Cypress Civil Development has provided 26 parking spaces on-site and will provide the remaining three parking spaces along E. 16th Street. The code allows a maximum of five parking spaces along adjacent streets. Locating the enclosure in the proposed parking area would reduce the number of parking spaces and not allow for the required 29 total parking spaces for the proposed development. Environmental Services will approve the service access from S. Russell Street given the need for the on-site area for parking spaces.

Section 5.3. G. As stated above, the 45 degree or 30 degree off-set from the adjacent public right of way is not provided. The proposed metal containers are two cubic yards in capacity and can be rolled out of the enclosure and placed on the west side of S. Russell Avenue for servicing. There are a total of eight single family residences on both sides of S. Russell Avenue between E. 16th Street and E. 15th Street. With this small number of residences on S. Russell Avenue, there will be limited traffic on this street. Therefore, the opening of the enclosure gates and placement of the two cubic yard containers (two containers) is not expected to interfere with traffic flow on S. Russell Avenue. Environmental Services currently provides waste servicing along S. Russell Avenue. Based on this analysis, Environmental Services will approve the orientation of the waste enclosure in the southeast corner of the site.

In summary, Environmental Services approves the solid waste management activities proposed in the Development Package for the Downtown Clifton Expansion project.
