SUMMARY: Engineering Division of Planning & Development Services Department has received and reviewed the proposed Development Plan Package and Stormwater Pollution Prevention Plan (Rick Engineering Co., 29JAN15). Engineering Division does not recommend approval of the Development Plan Package at this time. This review falls under the Unified Development Code (UDC), Administration Manual (AM) and Technical Standards Manual (TSM). Refer to the links for further clarification:

The following items need to be addressed:

DEVELOPMENT PLAN PACKAGE:

1) AM Sec.2-06.4.3: The relevant Development Plan Package case number (DP15-0014) may be added to the lower right hand corner of the plan on all sheets.

2) AM Sec.2-06.4.9.H.1: Revise the development plan package to provide a label for all construction improvements within the right of way of the new public roadways i.e. sidewalks, curbing, handicap access ramps, asphalt design, etc. It is acknowledged that a PIA has been submitted to TDOT; however these improvements at a minimum should be clearly labeled on the grading plan.

3) AM Sec.2-06.4.9.H.1: Approval of a Private Improvement Agreement permit through Transportation Permits and Codes is required for all work within the public right-of-way, this is to include the existing right-of-way of Speedway Blvd and the new right-of-way for the interior public streets.

4) AM Sec.2-06.4.9.M: Revise the development plan package to label the required removable bollards (or other approved method of separation) to prevent vehicles from driving into the basin into the basin access other than the required maintenance vehicles. Per UDC Sec.7.4.6.H.1 Barriers, such as post barricades or wheel stop curbing, are required in a vehicular use area to prevent vehicles from extending beyond the property lines, to prevent cars from damaging adjacent landscaping, walls, or buildings, overhanging adjacent sidewalk areas, and/or driving onto unimproved portions of the site.

5) AM Sec.2-06.4.9.M: Revise the development plan package to provide the required Fire Access Gate at the secondary access point along the south side of the property to prevent unauthorized access. The Fire Access Gate must meet Tucson Fire Department minimum requirements.

6) AM Sec.2-06.4.9.M: Per TSM Sec.8-01.8.1.A Placement of fill in excess of two feet [or a finished floor elevation (FFE) in excess of two feet plus the slab thickness] above existing grade at any location in the outer 100 feet of the developing site (less any intervening non-developable property outside of the site) shall require:
1. Written justification based on engineering/technical reasons; (COMPLETED)
2. Written permission of the Director of the PDSD;
3. Notification of the property owner(s) adjacent to the fill site (with copies to the Council Office and the Director of PDSD) prior to the approval of a grading plan. Said notification shall include reference to this ordinance, the justification presented as the basis for the excess fill, the approval letter from PDSD, and the name, address, and phone number of the owner/developer and the engineer of record. This notification shall occur early in the development process; and,
4. Preparation of a mitigation plan (i.e. additional setbacks, terracing, enhanced buffering/landscaping, etc.) acceptable to a simple majority of the notified property owners. The acceptability of the mitigation plan by the notified property owner(s) must be documented and made a part of the approved grading plan and permit. If the owner/developer and the notified property owner(s) cannot reach consensus on a mitigation plan within 15 working days of receipt of the property owners, the Director of PDSD shall review the issues and information and then render a final decision. Monitoring of grading activities shall be the responsibility of the engineer of record and certification of FFE's shall be done by a registered land surveyor hired by the permittee. Regulation, inspection, control of work, and enforcement of the above criteria shall be the responsibility of the Director of PDSD as stated in DS 2-01.13.

GENERAL COMMENTS:

Please provide a revised Development Plan Package that addresses the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments
