COMMENTS: Zoning conditionally approves the DP with the following comments addressed and changes made on the final plan sheets for CDRC Manager Signature.

01. Follow up to the previous comment: The short term bicycle facility for building one does not appear to be within fifty feet of the public entrance. Relocate the facility to meet the required fifty foot distance and label the actual distance.

Previous Comment 3. Follow up to previous comment 16: Address the following comments related to the bicycle parking.

Each building must be provided with two (2) long term bicycle parking facilities.

Draw and label the main entrance to the buildings 2 and three. Label the distance from the short term bicycle parking facilities to the main entrance of all buildings. The maximum distance is 50 feet.

02. Rezoning condition 13 requires construction of a six foot high masonry wall along the full length of the north boundary and along the east boundary north of the access entrance. The DP site plan was corrected to indicate the wall as required by the rezoning condition. The landscape plan must also be revised as required to show a six foot high wall along the east boundary as described by the rezoning condition 13.
2-06.4.9.U - Indicate graphically, where possible, compliance with conditions of rezoning.
The following comments are related to some of the rezoning conditions.

a. Per rezoning condition 13, a 6 foot high masonry wall must be provided along the entire north frontage and along the east perimeter from the Leonora Av. access drive to the north. The plans indicate a stepped wall which is contrary to the rezoning condition. Revise the plans as per the rezoning condition.

Based on the applicant's request a concurrent review is under way for Development Plan DP14-0064, a retail/restaurant project and Rezoning Case C9-14-03, Ina Group-Broadway, to change the land use zone from C-1 and R-3 to C-1, to allow the site to be redeveloped for retail and restaurant land use with drive-through lane(s).

Development Plan DP14-0064 must comply with rezoning case C9-14-03, which was authorized by Mayor and Council on August 5, 2014.


Community Planning staff offers the following comment:

As per the August 5, 2014, Mayor and Council public hearing held on August 5, 2014, rezoning case C9-14-03 was authorized with conditions. Community planning staff gives a Conditional Approval to this project, subject to the following revision and criteria, as outlined below:

Development plan DP 14-0064 shall be revised as following:

1. Development plan DP14-0064 shall be revised to be in compliance with rezoning condition #13, which reads as following:
" A six (6') foot tall masonry wall with no less than six (6) inch wide masonry block material shall be located as part of the landscape buffer along the full length of the north perimeter adjacent to 10th Street, and that portion of the east perimeter landscape buffer located north of the Leonora Avenue access entrance.

Although revised, development plan, Sheet C.3, dated 4.23.2015 still indicates a the masonry wall with a drop down height from 6 feet to 4 feet, and with a final height of 2 feet along Leonora Avenue north of the access entrance into the rezoning site. Please correct to show six feet in height for the entire length of wall, as required per rezoning condition # 13.
05/14/2015 ROBERT SHERRY PLUMBING-COMMERCIAL REVIEW Reqs Change 1. The revised development plan shows a private sewer collection system serving the three buildings on site and then discharging to public manhole PCWMD 8935-01. The rim elevation of this manhole is more than 12" below the floor elevations of the three buildings so a backwater valve will not be allowed. Reference: Section 715.1, IPC 2012, as amended by the City of Tucson.

2. If the private sewer collection system from the three buildings has a discharge rate of 3,000 gallons per day or greater, Pima County Department of Environmental Quality will have to review the design and provide an approval to construct the private sewer collection system. For a daily discharge rate of less than 3,000 gallons per day, the City of Tucson will review the plans for the private sewer collection system under a separate permit.

1. The added detail for the combination of the two single enclosures references the detail for the double enclosure. The footings for both enclosures called out in Detail 5 of Sheet C.2 is not correct per Figure 2 of TSM Section 8. The footing should be 1.0 ft thick x 1 ft. – 8 inches wide and the concrete shall be 3,000 psi. The concrete base for the bollards shall be 3 ft. deep. Also, add to the enclosure details that the Type B metal Deck for the gates is to be at least 1/8 inch thick per Figures 3A and 3B.
