Based on the applicant's request; a concurrent review is under way for Development Plan 13-0236, and Rezoning Case C9-13-14 InSite/GrantRoad, to change the land use zone from RX-2 residential to C-1 commercial zone, to allow the redevelopment of three parcels as one site to permit new building, required parking, and retail/restaurant land uses.

Currently the development plan has a CONDITIONAL approval pending minor corrections of the following items. Development plan DP13-0236; is subject to rezoning case C9-13-14, conditions of rezoning as approved on April 23, 2014by Mayor and Council.

Applicant to correct the following minor corrections. DP will require another resubmittal prior to the removal of the CONDITIONAL approval. The following are the minor corrections needed.

1. Prior to development plan approval, correct rezoning conditions (general notes) on C9-13-14, to read verbatim, as approved by Mayor and Council.

2. Prior to development plan approval, provide full size four-sided building elevations as supplemental building elevations to the development plan package. Building elevations to be in substantial compliance with the preliminary development package dated March 21, 2014, which includes color building elevations. Rezoning condition #12 also states building elevations shall display varying materials along all four sides of the proposed building.

3. Prior to development plan resubmittal, the proposed development plan, dumpster masonry wall enclosure elevations are not in compliance with rezoning C9-13-14, condition # 10, which states the six foot tall masonry wall shall be constructed of textured concrete block, and painted with a contrasting color band matching that of the principle building. Please provide color dumpster enclosure, four sided elevations to be in compliance rezoning condition # 10. If in a "detail," provide Key Notes.

***Jeff, I did my review based on the set of plans you left with me that included the changes made based on Manny Padilla's comments. The following comment is the only item left for full zoning approval. At this time I am granting a conditional Zoning approval pending the change being made to the final copy for the CDRC manager's signature.

Per your response to the previous follow-up comment, the distance from the patio area to the property line was to have been labeled. The distance to the north property boundary from the patio area could not be verified on the plan. Add the proposed distance. (The zoning of the WASH is RX-2.)

.14 Follow-up to previous comment 31: The following comments are related specifically to the rezoning conditions dated 4/13/14.

Condition 9: Your response to condition 9 states that the patio area is to be a minimum of 50 feet from the north property boundary. There is no dimension indicating the distance from the property boundary. Based on the scale of the drawing it appears that the distance from the fenced patio area is

Comment 2: Under the General Notes on sheet one, include the use specific standards for the Food Service Use with Alcoholic Beverage Service as a secondary use. The following section numbers were not listed under general note 3. The note shall include .3 & .5 through .9
