Ajo Way Solar Array at Plaza Del Sol Development Plan TRANSMITTAL DATE: November 9, 2010 DUE DATE: November 12, 2010 COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed. 1. Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is November 11, 2010. 2. This development plan is being reviewed with the acknowledgement of the developer that the Special Exception review and approval process is concurrent. All zoning comments offered with regards to the development package review are based on compliance with DS 2-01 standards and additional applicable development standards as well as compliance with Land Use Code development criteria. Additional comments may be forthcoming based on the special exception conditions of approval. Please be aware that the development plan may not be approved until the special exception process is completed and when all conditions of the special exception approval have been incorporated into the development plan. (a conditional approval from CDRC may be possible but permits may not be issued until all requirements have been addressed.) 3. DS 2-01.3.2.D, Clarify if the address under the Owner/Developer text block is also the Administrative address. 4. DS 2-01.3.3, If applicable, relevant case numbers (development package document, rezoning, board of adjustment, DDO, MDR, DSMR, overlay, etc.) shall be provided adjacent to the title block on each sheet. The case numbers will also be listed as a general and include the date of approval and any conditions of approval. 5. DS 2-01.3.7.A.6.a, List the Special Exception case number next to the title block of all plan sheets and also as a general note and should include the date of approval and conditions of approval. 6. DS 2-01.3.8.D, As of this review it is not clear if TOT has given an official approval for the use of five (5) feet of the Valley Road right-of-way for compliance with the ten (10) foot landscape border. Provide documentation from TDOT and also clarify if TDOT will be seeking some form of easement for this landscape area in the right-of-way. Also verification from TDOT is required with regards to whether or not a curb and/or sidewalk will be required along the extents of the of the site boundary along the Valley Road frontage. (Additional comments on this item may be forthcoming from the landscape, zoning, and engineering reviewers. 7. DS 2-01.3.9.F, Label the zoning classification for the property across Valley Road. The zoning classification is R-1. 8. DS 2-01.3.9.Q, The overall height of the panel could not be verified on the plan sheets. Detail 6 on sheet 8 is not very clear and does not show the panel at its tallest when perpendicular to the ground. It is also not clear why the height minimums are labeled as 2' except for the center pole. Please clarify. 9. DS 2-01.3.9.X, Refer to the landscape reviewer comments for information related to landscaping and screening, and NPPO. 10. Zoning has no comments on the grading plan at this time on this review. The preliminary grading plan is consistent with the preliminary development plan. However any changes that are made to the development plan must be made on the grading and landscape plans to ensure consistency. Based on the applicant's request, a concurrent review of both the Special Exception and development plan are being conducted by staff. Prior to approval, development plan D10-0036 is required to comply with any and all conditions approved through the Special Exception process. Therefore, the following revisions to the development plan, as outlined by staff are subject to the Special Exception, as approved by Mayor and Council at a future date. Any changes by Major and Council on the Special Exception consideration shall be addressed by the applicant prior to resubmittal of the development Plan. Staff offers the following comments: 1. Prior to development plan approval, record a one-foot no access easement along Valley Road, on that portion of the mobile home park site utilized by the solar renewable energy generation facility. 2. Please revise development plan (landscape section), sheets 16-20 to provide a ten-foot wide landscape buffer adjacent to that portion of the southern perimeter utilized by the solar renewable energy generation facility. Landscape buffer to include landscape material as shown along Valley Road edge and trees to be thornless native mesquite trees, at a ratio of one tree every twenty-five linear feet. 3. Please revise development plan to indicate the proposed on-site fencing located along the western perimeter of the solar renewable energy generation facility to be constructed of a material such as used along perimeters of school grounds, a combination of angle/wrought iron material designed so as to not allow climbing and the top design to discourage jumping over. Also provide a scaled fence elevation of the western perimeter fence. 4. If the solar renewable energy generation facility site is identified as a restricted and/or hazardous area, then revise the development plan to include signage information (include sign elevations) and location(s) of signs which are to be posted along all its perimeters. 5.
