Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is 01/24/08. 2. This project is currently under a rezoning application. Further comments will be forth coming based on the rezoning conditions. Incorporate into this plan any changes required by the rezoning conditions at the time of the next submittal. 3. Please review Development Standards 2-05 for format and content for a Development Plan submittal. 4. DS 2-05.2.1.C All lettering and dimensions shall be the equivalent of twelve (0.12") point or greater in size. The purpose of this requirement is to assure that all lettering is legible when reviewed and will maintain that legibility when reproduced and photographically reduced (microfilmed) for record-keeping purposes. Sheet A-01 does not meet this requirement. Remove all references to a site plan. Provide a title block (preferably in the lower right corner) clearly indicating this is a Development Plan. See later comment on content of the title block. Renumber all sheets in order to provide chronological order for this set of plans. Revise all detail call outs to reflect the change in page numbers. 5. DS 2-05.2.1.D A small, project-location map shall be drawn on the first sheet of the development plan, preferably in the upper right corner. The map should cover approximately one (1) square mile, be drawn at a minimum scale of 3" = 1 mile, and provide the following information. 1. Show the subject property within the one (1) square mile area. 2. Identify conditions within the square mile area, such as major streets and watercourses. 3. Section, township, and range; section corners; north arrow; and the scale will be labeled. 6. DS 2-05.2.1.G The following title block information is to be provided, preferably in the lower right corner of the sheet. 1. The proposed name of the project or, if there is no name, the proposed tenant's name or the property address. 2. A brief legal description. 7. DS 2-05.2.1.H The north arrow, contour interval, and scale should be placed together on each sheet, preferably in the upper right corner of the plat. 8. DS 2-05.2.2 List the applicable rezoning file number and conditions of approval. Also place the Rezoning case #C9-__-__ and the Development Plan # D06-0054 file numbers in the lower right corner of the plan or in that vicinity. 9. DS 2-05.2.2.3 List as the proposed use "General Merchandise Sales "31" subject to: 3.5.9.2.A-------Gasoline Sales--Retail". 10. DS 2-05.2.2.10 Add a note stating that "This project is designed to meet the overlay zone criteria: Sec.2.8.3 Major Streets and Routes (MS&R) Setback Zone." 11. DS 2-05.2.2.11 List the gross lot area of the site by square footage and acreage. The gross lot area indicated appears to be for the entire site. List as the gross area only the area of the project to be developed. 12. DS 2-05.2.3.B If applicable, all easements shall be drawn on the plan. The recordation information, location, width, and purpose of all easements on site will be stated. Blanket easements should be listed in the notes, together with recordation data and their proposed status. Should an easement not be in use and be proposed for vacation or have been abandoned, so indicate. However, should the easement be in conflict with any proposed building location, vacation of the easement is to occur prior to issuance of permits. 13. DS 2-05.2.4.A There appears to be a lot reconfiguration being done at the east side of the property. Provide documentation that the lot reconfiguration has been approved by the City of Tucson. FYI: The 26' wide remainder of the property to the east will be considered a non-buildable lot and will not be approved in the proposed lot reconfiguration. The remainder portion of the lot could be combined with the main portion of the shopping center property. This property is operating in conjunction with the shopping center but could be sold as a separate stand alone property therefore a lot combination covenant will be required. A copy of the lot combination covenant can be obtained from the City of Tucson DSD web site. Provide the recordation information (docket and page) on the development plan. Provide a copy of the cross access agreement with the shopping center. Provide distance and bearings for all lot lines. 14. DS 2-05.2.4.F Provide the ½ future right of way line for Broadway. The MS&R width for Broadway at the intersection is 75' because of the intersection widening. 15. Ds 2-05.2.4.K Pedestrian circulation is required from each street on which the project is adjacent to. See DS 2-08.3.1 and DS 2-08.4.1.A. A pedestrian path (sidewalk) is required from Broadway to the building and connecting to the rest of the shopping center. A suggestion would be to provide a sidewalk from the southeast corner of the kiosk directly east connecting to the existing sidewalk in the shopping center with a cross walk and handicap ramps. This suggestion would meet the requirement for both the connection to Broadway and the rest of the shopping center. A sidewalk is required between the building (kiosk) and the handicap parking spaces at the west side of the building. See DS 2-08.4.1.C. Revise the handicap ramps and detail 8 of A-11. A handicap ramp will then be required at the handicap access aisle. A sidewalk is required along the north side of the handicap parking space. Striped cross walks are allowed only to cross a PAAL not be parallel to a vehicular use area. See DS 2-08.4.1 Sidewalks within a project must be physically separated from any vehicular travel lane by means of curbing, grade separation, barriers, railings, or other means, except at crosswalks. A handicap ramp will be required to be located at the west end of this sidewalk connecting to the cross walk. Clearly indicate the location, with dimensions, of the required 5' wide pedestrian refuge area per DS 3-05.2.2.B.1 A minimum setback distance of five (5) feet for a pedestrian refuge area must be maintained between any enclosed structure and a PAAL. Clearly indicate the width of all required sidewalks and cross walks as per DS 2-08.5.1.A All sidewalks will be a minimum four (4) feet wide and will be installed to avoid any obstruction which decreases the minimum width to less than four (4) feet. 16. DS 2-05.2.4.N On the drawing, show the locations and footprints of all structures. Label the heights and dimensions. 17. DS 2-05.2.4.P The parking calculations provided for the number of required parking spaces is incorrect. Per LUC Sec. 3.3.4 under the Retail Trade Use Group, General Merchandise Sales---Gasoline Sales -Retail, The number of required parking is one per employee with a minimum of two required. Revise the required calculations. On detail 6 of A-11 for the handicap parking sign indicate the minimum distance from grade to the bottom of the Reserved Parking sign. Minimum distance as per City of Tucson standards is seven (7) feet. 18. DS 2-05.2.4.Q Per the LUC Sec. 3.3.4 referenced in the above comment bicycle parking is not required. Revise bicycle parking calculations to indicate none being required. If bicycle parking is being provided it must meet the requirements of DS 2-09 for location, clearances, type of rack, etc. Provide appropriate details. 19. DS 2-05.2.4.R Provide the locations of all sight visibility triangles including existing and future. See engineering comments. 20. DS 2-05..2.4.U Indicate graphically, where possible, and by notes, in all other instances, compliance with conditions of rezoning. Provide as a separate document how each of the rezoning conditions have been meet. 21. DS 2-05.2.4.V Indicate location and type of postal service to assure there are no conflicts with other requirements, such as pedestrian accessibility, utilities, and landscaping. 22. If applicable, indicate the locations and types of proposed signs (wall, free-standing, pedestal and billboards) to assure there are no conflicts with other requirements and that minimal locational requirements can be met. 23. This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents. Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the development plan. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet. The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $100.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter. If the number of sheets changes, please adjust the review fee accordingly.
