04/20/2026 Zoning Administration Standard REQUIRES RESUBMIT The property at 803 E Helen St. currently houses a design firm. You are seeking nonconforming status for the property. This status cannot be confirmed without additional information. Additionally, there are no permitting records or a Certificate of Occupancy on record for the current tenant. There are several issues that need to be addressed for the current use to continue.
1. To confirm the nonconforming status, please note the following:
a. Preliminary research of the available historic records indicates the property at 803 E Helen St. has been used over the years for retail uses. The last nonconforming status record is from 1991 for a retail clothing store. Visual records indicate the location was vacant for several years before the current tenant located there in approximately 2023.
b. To maintain nonconforming status, a nonconforming use cannot be discontinued per UDC 9.2.1 (https://codelibrary.amlegal.com/codes/tucson/latest/tucson_az_udc/0-0-0-6910). Additional information is needed from the applicant to indicate the use was not discontinued. This can include “business license records and/or utility records and the continued maintenance of the property which indicates the intent to continue or discontinue such use.”
c. The Unified Development Code allows substitution of nonconforming uses per UDC 9.2.3. and 9.2.4. (https://codelibrary.amlegal.com/codes/tucson/latest/tucson_az_udc/0-0-0-6924). The proposed use is for a commercial use – Administrative and Professional Office. This is from a different land use class the last records indicate. As such, a Zoning Examiner Special Exception Procedure may be required.
2. A new Certificate of Occupancy will likely be necessary, regardless of the outcome of the nonconforming status request.
3. Next steps: submit documentation that per item b. that the use was not discontinued. After review, we will provide additional directions on next steps.
