As such, we are unclear why it continues to be classified or treated in a way that restricts commercial use. At the time of purchase, we were informed that the property was dual-zoned, allowing for both residential and commercial uses. While we understand that the current zoning does not permit “Retail Merchandising,” the building has historically supported retail uses, including tenants such as Buffalo Exchange and a grocery market. Both its history and physical layout clearly reflect its original function as a retail space. The property features a dedicated parking lot with covered parking for customers and is located along a busy street with significant pedestrian traffic. In fact, we frequently have individuals walk in expecting a retail-type environment, further reinforcing how the building presents itself. Given this history, it appears that retail use was permitted at one point. We would greatly appreciate any clarification on this matter, as well as guidance on the steps required to reestablish or obtain approval for retail use under the current zoning regulations.
