To whom this may concern,
Thank you for the opportunity to comment on TD-DEV-1223-00497, 2nd Submittal, a development plan for a 19 unit multifamily housing development at 839 East Minorka Rd. This development is located in the S.W. quarter of the S.W. quarter of Section 6, Township 15S, Range 14E, of the Gila and Salt River Meridian. The development site occupies parcel number 140-19-0170, covers approximately 0.877 ± acres, and is zoned as Residence Zone 2 (R-2). The nearest major roadway intersection is East Minorka Road and South Park Avenue, approximately 350 feet to the southeast of the subject development.
This site does lie within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.
The Tucson Airport Authority approves the proposed project and is not requiring a resubmittal.

03/22/2024 Site Engineering REQUIRES RESUBMIT 1. The proposed “Rockwells” are considered dry-wells and require approval of the floodplain administrator. Drywells must meet all requirements per COT Stormwater Detention Retention Manual 3.5.5, COT Drainage Design Manual July 1998 Revision Section 14.5, and the Pima County Detention/Retention Manual with City of Tucson Amendments Section 14.19
2. The proposed Basin locations conflict with 4.12.1.2, 4.14.1.2, & 4.14.1.3 of the Detention-Retention Manual. Wall within 5’ of the 100-year water surface elevation, and structure setbacks of 15’. This 15’ setback is also mentioned in your geo report dated 10-01-2008 that was submitted as supporting documentation in appendix C of your revised drainage report.
3. Comment 5 was not addressed. Table 4.1 of detention-retention manual requires W.W.F. Reinforcing. Please add detail.
4. 4.6.2 of the detention-retention manual prohibits the use of decomposed granite or rock less than 4” in diameter on the basin floor.
5. Comment 16 not addressed. Please provide easement abandonment documentation.
6. Comment 12: TSM 10-01.4.2.F.2 – Handrails will be required for any ramp other than a curb ramp with a rise greater than 6”. Identify as curb ramps or provide handrail.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is December 28, 2024.

2-06.4.0 Content Requirements:

1. 2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses.

COMMENT: Multifamily use in the R2 zone has the following use specific standards; UDC Article 4.9.7.B.6,.9,.10. Add the applicable use specific standards reference to the zoning note on the Cover Sheet and ensure compliance with the required standards.

2-06.4.9.H Proposed Traffic Circulation

2. 2-06.4.9.O - All applicable building setback lines, such as erosion hazard, floodplain detention/retention basins, and zoning, including sight visibility triangles, will be shown.

COMMENT: Per UDC Table 6.3-2.A, the required setback in the R2 zone for a nonresidential use adjacent to a Residential zone is the greater of 10’ or ¾ the height of the proposed building wall.

Provide the required setbacks on the site plan and as a General Note per the above standard. The western property line setbacks shown on the Site Plan show a required setback of 7 feet 4 inches, the minimum required setback is 10 feet. Change the required setback to show the required minimum setback.

3. COMMENT: As the property is made up of two separate parcels a lot combination will be required.
The dimensions of the newly configured lot will have to match the lot split as shown in permit TD-DIV-0324-00020. As the proposed lot configuration shown in the DP is dependent on a proposed lot split, TD-DIV-0324-00020 will have to be approved, along with proof of the recorded lot combination will need to be provided before this DP can be approved.
