This development is located in the S.W. quarter of the S.W. quarter of Section 6, Township 15S, Range 14E, of the Gila and Salt River Meridian. The development site occupies parcel number 140-19-0170, covers approximately 0.877 ± acres, and is zoned as Residence Zone 2 (R-2). The nearest major roadway intersection is East Minorka Road and South Park Avenue, approximately 350 feet to the southeast of the subject development. This site does lie within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace. The Tucson Airport Authority is requiring a resubmit of this project. These conditions must be included in the plan documents and shall be identified in the general notes section of all future plans submitted to the City of Tucson for review. Conditions of approval: 1. “According to the Federal Aviation Administration (FAA) Notice Criteria Tool, no Notice Criteria are exceeded. Applicants are therefore not required to file FAA Form 7460. However, if the use of cranes is anticipated during development and construction activities, the applicant must file FAA Form 7460 at least 45 days in advance of such use, to provide the applicant with sufficient time to respond to any concerns identified by the FAA. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp.” Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the applicant add the following notes into the general notes of the revised development plan. This project is located approximately 1.28 miles north of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport. The proposed notes would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through the property owner recording the Avigation Easement and providing the Airport Disclosure Statement to the new residents of all residential uses. The Tucson Airport Authority believes the proposed note helps to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson – Regional and Global Positioning policy 4 (RG-4). 1. "That prior to the City's approval of the proposed development, the property owner must record the Avigation Easement that discloses the existence and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided.” The current property owner or person authorized to sign on behalf of the current property owner must complete, sign, and record the Avigation Easement. COMMENTS: 1. Ensure all Zoning and Engineering comments are addressed prior to the Landscape/NPPO comments. 2. Please include the correct Development Package number, TD-DEV-1223-00497 on all landscape & NPPO sheets. 3. There must be an NPPO Plan or NPPO Exemption form filled out. This must be filled out by a licensed professional, ie. Arborist or Landscape Architect. 4. Please label all existing and future rights of way for Minorka 7.6.4.C.2.a. on all sheets 5. Show all site visibility triangles on plan set sheets. 6. DTM approval is required for any and all planting or irrigation in the ROW prior to the approval of the development package. Using Low Impact Development design and water harvesting provides critical basin detention and first flush retention for all new development and impervious area. This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is December 28, 2024. 2-06.4.0 Content Requirements: 1. 2-06.4.1 - The name, mailing and email addresses, and phone number of the primary property owner of the site, the developer of the project, registrant(s), and other person(s), firm(s), or organization(s) that prepared the development package documents shall be provided on the right half of the cover sheet. COMMENT: Provide the above information for the property owner. 2. 2-06.4.2 - The title block shall include the following information and be provided on each sheet: a. 2-06.4.2.D - The page number and the total number of pages in the package (i.e., sheet xx of xx). COMMENT: Add the above information to each sheet. 3. 2-06.4.3 - The administrative street address and relevant case numbers (development package document, subdivision, rezoning, board of adjustment, DDO, MDR, DSMR, overlay, etc.) shall be provided adjacent to the title block on each sheet. COMMENT: Provide the plan number, TD-DEV-1223-00497, in the Title Block of each sheet. 4. 2-06.4.7.A.2 - List the gross area of the site/subdivision by square footage and acreage. COMMENT: As the proposed project consists of two parcels, provide the square footage and acreage for each parcel separately on the Cover Sheet. 5. 2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses. COMMENT: Multifamily use in the R2 zone has the following use specific standards; UDC Article 4.9.7.B.6,.9,.10. Add the applicable use specific standards reference to the zoning note on the Cover Sheet. 6. 2-06.4.7.A.5 - On residential projects, list the total number of units/lots proposed. COMMENT: Provide a note on the Cover Sheet or Site plan stating the total number of proposed units of the project. 7. 2-06.4.7.A.8 - For development package documents provide: a. 2-06.4.7.A.8.a - Floor area for each building; COMMENT: Provide the floor area for each building as a General Note on the Cover Sheet per the above standard. 2-06.4.8 - Existing Site Conditions a. 2-06.4.8.C - The following information regarding existing private or public right-of-way adjacent to or within the site shall be provided: the name, right-of-way width, recordation data, type and dimensioned width of paving, curbs, curb cuts, and sidewalks. COMMENT: Provide the above information for Minorka Road. 2-06.4.9.H Proposed Traffic Circulation 8. 2-06.4.9.H.5 - If utilizing parking area access lanes (PAALs), they shall be designed in accordance with Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC. COMMENT: Per UDC Table 7.4.6-2, A two-way PAAL must have a minimum width of 24’. It appears that the PAAL on the south side of the property is measure from the end of the parking space and over a walkway. Clarify what the use is for the strip going along the southern border of the property and connecting into the proposed sidewalk. 9. 2-06.4.9.O - All applicable building setback lines, such as erosion hazard, floodplain detention/retention basins, and zoning, including sight visibility triangles, will be shown. COMMENT: Provide the required setbacks on the site plan and as a General Note per the above standard. COMMENT: Per UDC Article 6.4.5.C.2.b, “For multifamily development abutting a Local Street: the minimum required street perimeter yard is 20 feet, as measured from the street property line.” COMMENT: Per UDC Table 6.3-2.A, the required setback in the R2 zone for a nonresidential use adjacent to a Residential zone is the greater of 10’ or ¾ the height of the proposed building wall. With a proposed building wall height of 44 feet 7 inches, the required setback to the western property line is 33 feet 6 inches. The proposed western units encroach into the required western property boundary setbacks and a Design Development Option will be required. A height was not provided for the units on the northern property line. However, if the proposed units will have a building wall height of 44 feet 7 inches, the required setback will be 33 feet 6 inches to the northern and eastern property lines. The proposed northern units encroach into the required eastern property boundary setbacks and a Design Development Option will be required. A Design Development Option (DDO) must be applied for and approved before this permit can be approved by Zoning. Height is defined as, “ Building height is the vertical distance measured from the design grade elevation to the highest point of a flat roof; to the deck line of a mansard roof; or to the middle (between the eave and ridge ) of the highest gable of a pitched or hipped roof (UDC Article 6.4.4.A).” Provide a measurement between the eave and ridge to determine if the required height is being met. If the height of the proposed buildings exceed 25 feet, per the above standard, a Variance will be required. 11. 2-06.4.9.V - For gang mailboxes indicate location to assure there are no conflicts with other requirements, such as pedestrian accessibility, utilities, and landscaping. COMMENT: Add a note stating where mail service will take place (i.e. to each unit, or gang mailbox). 12. COMMENT: As the property is made up of two separate parcels a lot combination will be required. Proof of the recorded lot combination will need to be provided before this DP can be approved.
