Thank you for the opportunity to comment on TD-DEV-1123-00450, a development plan for second principle use of an alcoholic beverage service at 1110 S 6th Ave. This development is located in the S.W. quarter of the S.E. quarter of Section 13, Township 14S, Range 13E, of the Gila and Salt River Meridian. The development site occupies parcel numbers 117-09-2000, covers approximately 0.21 ± acres, and is zoned as Commercial Zone 3 (C-3). The nearest major roadway intersection is East 21st Street and South 6th Ave, approximately 100 feet to the northeast of the subject development.
This site does lie within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace. The Tucson Airport Authority approves the proposed project and is not requiring a resubmittal. COMMENTS: Please resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is November 19, 2024.

2-06.4.0 CONTENT REQUIREMENTS

1. COMMENT: 2-06.4.1 – Provide the email address and phone number for the owner developer shown on the plan.

2. COMMENT: 2-06.4.2.D – Provide the page number and the total number of pages in the package (i.e., sheet xx of xx) within the title block.

3. COMMENT: 2-06.4.3 – Provide the development package case number, TD-DEV-1222-00, adjacent to the title block on all sheets.

4. COMMENT: 2-06.4.4 - The project-location map shall cover approximately one square mile, be drawn at a minimum scale of three inch equals one mile

5. COMMENT: 2-06.4.4.C – Provide the section, township, and range; label the section corners, and provide the scale of the location map.

2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

2-06.4.7.A - Zoning and Land Use Notes

6. COMMENT: 2-06.4.7.A.4 – General Note 3 lists the current use as Assembly but assembly is not a use designated in the UDC. The last use was approved as an art studio, and is considered general merchandise sales and was approved based on prior permits and C of OS for retail uses. The art studio was not approved under UDC Article 3.3.3.H. Revise General Note 3 to read “EXISTING USE GENERAL MERCHANDISE SALES, PROPOSED USE GENERAL MERCHANDISE SALES, EXCLUDING LARAGE RETAL ESTABLIXHMENT, SUBJECT TO USE SPECIFIC STANDARD 4.9.9.B.1 & ALCOHOLICE BEVERAGE SERVICE: EXCLUDING A LARGE BAR”.

7. COMMENT: 2-06.4.7.A.6.a - As 6th Ave. is designated as an Arterial on the COT MS&R Map provide a general note on the cover sheet stating “THIS PROJECT IS DESIGNED TO MEET THE OVERLAY ZONE(S) CRITERIA, UDC ARTICLE 5.4 MAJOR STREETS AND ROUTES SETBACK ZONE (MS&R)

2-06.4.7.A.8 - For development package documents provide:

8. COMMENT: 2-06.4.7.A.8.a – General Note 22 remove the reference to “ASSEMBLY (A3)” and show this as General Merchandise Sales.

2-06.4.8 - Existing Site Conditions
The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided.

9. COMMENT: 2-06.4.8.A - Provide site boundary perimeter information, including bearing in degrees, minutes, and seconds.

10. COMMENT: 2-06.4.8.C – Provide the following information for 6th Ave., dimensioned width of paving, curbs, curb cuts, and sidewalks.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

11. COMMENT: 2-06.4.9.H.5.a – The vehicle parking spaces calculation is not correct. Remove the reference to “ASSEMBLY (A3)” and show this as General Merchandise Sales. The required ratio should be 1 space per 300 gfa and the required should be 6. As this site is nonconforming for vehicle parking for a retail use, no additional parking is required for the retail use.

12. COMMENT: 2-06.4.9.H.5.a – Remove the reference to “TOTAL PER UDC 3.3.3(h) 10 TOTAL SPACES” as this is not applicable, see comment 6.

13. COMMENT: 2-06.4.9.H.5.a – The provided number of vehicle parking spaces should be “0” as no onsite vehicle parking space have been provided.

14. COMMENT: 2-06.4.9.H.5.a – Remove the reference to “ACCESSIBLE SPACES REQUIRED” as no parking spaces have been provided within the parking facility, 2018 UBC Table 1106.1.

15. COMMENT: 2-06.4.9.H.5.a – Per UDC Article 7.4.3.D.3 the required number of vehicle parking spaces for the proposed Alcoholic Beverage Service shall be provided. Zoning acknowledges that you are proposing to eliminate vehicle parking space via an Individual Parking Plan (IPP). Until the IPP is approved Zoning cannot approve this DP. If the IPP is approved and there are conditions of approval list the conditions on the plan.

16. COMMENT: 2-06.4.9.H.5.d – The short- & long-term bicycle parking calculation is not correct. Remove the reference to “ABS” & “GALLERY” and provide the correct uses as stated in comment 6. The bicycle parking calculation shall include the number required & provided.

17. COMMENT: 2-06.4.9.H.5.d – The short- and long-term number of required spaces for “ABS” is not correct. Per UDC Table 7.4.8-1, COMMERCIAL USE GROUP, Alcoholic Beverage Service the minimum required is 2 each. Per UDC Article 7.4.3.D.3 the required number of short- & long-term bicycle parking spaces for the proposed Alcoholic Beverage Service shall be provided on site. If you choose to eliminate the bicycle parking a Board of Adjustment for variance is required.

18. COMMENT: 2-06.4.9.H.5.d – The short- and long-term number of required spaces for “GALLERY” is not correct. Per UDC Table 7.4.8-1, RETAIL TRADE USE GROUP, Retail Trade Uses Less Than 50,000 sq. ft. GFA, the minimum required is 2 each. As this site is nonconforming for bicycle parking for a retail use, no additional parking is required for the retail use.
