Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year expiration date is November 20, 2025.

SECTION 2-06.0.0: DEVELOPMENT PACKAGE

2-06.4.9.H.5.b - If any of the required parking is located off-site as permitted by the UDC, a drawing of that parking area is to be provided, together with the city's required parking agreement (include a copy of the lease agreement if applicable) must be provided. Please remember that in these situations, if the off-site parking location is a new parking area, it must comply with all parking area requirements and must be allowed as a principal use by the zoning classification of that property. If the off-site parking area location is an existing parking lot, the parking spaces utilized for the proposed land use must be non-required parking for the existing use for which the parking area was established.

1. COMMENT: 2-06.4.9.H.5.b – The required number of parking spaces for this proposal is correctly cited at 39 based upon the two uses and their total square footage. The current approved Individual Parking Plan applied to the previous DP, which had a total parking space requirement of 10.

Based on the expansion of floor area from the last approved DP, the new total amount of required motor vehicle parking spaces is 39 as is cited on the submitted plans, of which two must be accessible (one of which must be van accessible).

Site Zoning acknowledges that based upon the above-stated expansion of floor area, you are proposing to eliminate additional vehicle parking spaces via a new updated Individual Parking Plan (IPP). Until the new updated IPP is approved Site Zoning cannot approve this DP. If the IPP is approved and there are conditions of approval list the conditions on the plan.

11/26/2024 Zoning Modifications - IPP REQUIRES RESUBMIT An Individual Parking Plan (IPP) is an option that can be used to reduce the required number of vehicle parking spaces. This project is located within 400’ of R-3 zone and is subject to the 400’ Notice Procedure (UDC Section 3.3.5). A neighborhood meeting is required prior to submittal of an application. The IPP Narrative, sealed by a design professional licensed by the State of Arizona, must include the information as outlined in UDC Section 7.4.5.A.4.a – m.
