Please clarify proposed waste disposal method. Waste stream calculations for this site indicate that a metal container is required - TSM Sec 8. A Technical Standards Modification Request (TSMR) may be submitted to Andy Vera of Environmental Services. 4. Please provide the Development Plan number in the title block on each page. 5. | 01/17/2025 | Site Zoning | REQUIRES RESUBMIT | PDSD TRANSMITTAL FROM: Ramiro Olivarez PDSD: Zoning Review PROJECT: Solar Shade Structure - 4407 S 6TH AV Development Package (1st Review) TD-DEV-1024-00296 TRANSMITTAL DATE: January 17, 2024 DUE DATE: January 13, 2025 CHECKLIST FOR MINOR DEVELOPMENT CHANGES TO EXISTING COMMERCIAL/INDUSTRIAL SITES Purpose This standard has been prepared for the purpose of informing applicants of the submittal and review requirements for minor changes to existing commercial sites to assure proper and adequate information is presented in a consistent manner, thereby providing the basis for an efficient and timely review. The minor revisions to existing commercial sites are prepared in support of applications for building permits and related reviews. The information that is requested establishes the basis upon which the project will be approved and could affect what is required of the property in the future, should there be a proposal for expansion or for a different use of the property. This standard does not waive any applicable city regulations or codes. Applicability This standard shall be used for minor changes to existing commercial sites such as but not limited to; expansions less than 25% in square footage of land area, floor area, lot coverage, or vehicular use area, modification to accessible vehicle parking, parking area restripe, etc. Applicability to be determined by Zoning and/or Engineering review staff via email or at PDSD review counter APPLICATION SUBMITTAL REQUIREMENTS Development Package applications are available from PDSD. Completed applications and accompanying materials shall be submitted to PDSD. Incomplete or inaccurate applications will not be accepted. The types of documents and the specific number of copies required of each of the documents are on the PDSD website or may be obtained from PDSD. Resubmittals of development packages require a comment response letter that details how all previous comments have been addressed. Provide the same number of copies of the comment response letter as plans provided. The following documents and information shall be submitted upon application: 1. A completed application signed by the property owner or authorized designed. 2. A development package must be prepared to the format and content requirements described herein. 3. Fees in accordance with Section 4-01.0.0, Development Review Fee Schedule or as determined on an hourly rate. CONTENT REQUIREMENTS 2. The title block shall include the following information and be provided on each sheet: The proposed name of the project, or if there is no name, the proposed tenant’s name. A brief legal description is to be provided. The page number and the total number of pages in the package (i.e., sheet xx of xx). The administrative street address and relevant case numbers (development package document, subdivision, rezoning, board of adjustment, DDO, MDR, DSMR, overlay, etc.) shall be provided adjacent to the title block on each sheet. PREVIOUS COMMENT 2: A Design Development Option (DDO) may be required for the east building setback as it relates to the proposed solar canopy. FOLLOW UP TO COMMENT 2: The perimeter yard setback along the eastern property line (12.53’) does not comply with the minimum setback (23.093’). Per UDC 6.3-4.A, the minimum perimeter yard setback is 1½(H) the height of the exterior wall (the post) of the canopy. 1.5 * 15’4 ¾” (H of the wall) = 23.093 foot East property line setback. The setback for nonresidential use abutting residential zone is 1½(H) of the wall (the post). As the east property line setback depicted is 12.53’ at a minimum a neighbors setback waiver will be required, per UDC Article 6.6.2.D. To secure this neighbor setback waiver the following statement must be provided on the Site plan and be signed and dated by the adjacent property (14 E AVIATION DR) owner(s) (SIERRA VIRGINIA L & SIERRA PATRICIA A JT/RS): My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan. Signature: _____________________________ Date: _________________________________ **If you are unable to secure the neighbor waiver a Design Development Option (DDO) application must be submitted for review and approval. The structure encroaches into the required perimeter yard at 12.53’ (as depicted on the plan) and does not comply with the required minimum setback of 23.093’. This will require the approval of a Design Development Option (DDO) before zoning can approve this permit. The below paperwork can be filled out and submitted with the next submission. GENERAL NOTES The following general notes are required. Additional notes specific to each plan are required where applicable. 3. Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses. PREVIOUS COMMENT 3: List as a general note the existing use per the most current approved Certificate of Occupancy (CofO), Food Service (T09OT00500). If the use is different from the last approved CofO then provide the documentation for the current or new use of this property as noted by the Standard above. FOLLOW UP TO COMMENT 3: List the Use specific standards applicable to this use (Food Service). (C-2: 4.9.4.M.1 and 4.9.13.P) (As found in the C-2 Permitted use table, https://codelibrary.amlegal.com/codes/tucson/latest/tucson_az_udc/0-0-0-2103) 5. Percentage of gross floor area, land area, or vehicular use area expansion. If the building(s) or lot area have been previously expanded, those calculations shall be included. NEW COMMENT 4: Upon further review, no permit documentation could be verified for the existing Connex storage container located on the southeast of the property, as depicted on the site plan. Dimension the square footage of the existing container and provide the expansion calculations as noted by the standard above. Additionally, this storage container has been placed on the south adjacent parcel. The storage container cannot be placed on the adjacent south parcel. The storage container will need to be relocated within parcel boundaries with a permit or provide permit documentation for the existing Connex storage container. EXISTING SITE CONDITIONS: 2. All existing easements shall be drawn on the plan. The recordation information, location, width, and purpose of all easements on site will be stated. PREVIOUS COMMENT 5: Add all recordation information for all utility’s drawn and labeled on the plan. (Clarify if the existing building is built over the southern property line. And if so provide any documentation. Dimension the area of the building that encroaches into south adjacent property.) FOLLOW UP TO COMMENT 5: Identify and label the recordation information for all Utility Easements depicted along the east of the parcel. Clarify, is this a ground or aerial easement? There appears to be vehicle traffic traveling from north to south, entering and exiting through the 17.9’ curb opening depicted on the site plan. Clarify, is there a cross-access easement in this area where vehicular use is occurring. Part of this vehicle travel lane is located on the east adjacent property (Address: 14 E AVIATION DR). Identify and label the recordation information for the cross-access easement. NEW COMMENT 6: Upon further review, there is a wall located on the southwest corner of the building spanning to the right of way along 6th Av. Draw and label this wall on the site plan. INFORMATION OF PROPOSED DEVELOPMENT: The following information on the proposed project shall be shown on the drawing or added as notes. 2. Show all motor vehicle off-street parking spaces provided, fully dimensioned. As a note, provide calculations on the number of spaces required (include the ratio used) and the number provided, including the number of spaces required and provided for the physically disabled. The drawing should indicate parking space locations for the physically disabled. A typical parking space detail shall be provided for both standard parking spaces and those for the physically disabled. For information on parking requirements for the physically disabled, refer to adopted building and accessibility codes of the City of Tucson. Design criteria for parking spaces and access are located in Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC. PREVIOUS COMMENT 7: Draw, label, and dimension all motor vehicle off-street parking spaces as noted by the Standard above. FOLLOW UP TO COMMENT 7: The area under the proposed canopy covered parking shall be drawn, labeled, and dimensioned and in compliance with UDC 7.4.4 and 7.4.6. Demonstrate vehicle access and maneuverability to the proposed canopy covered parking. Additional comments may be forthcoming based on the design layout of the covered canopy vehicle parking and its adjacency to barriers. 5. All proposed easements (utility, sewer, drainage, access, etc.) are to be dimensioned and labeled as to their purposes and whether they will be public or private. The easements may have to be recorded and the recordation information added to the development package prior to approval. PREVIOUS COMMENT 8: If applicable draw, label, and dimension all proposed easements as noted by the Standard above. FOLLOW UP TO COMMENT 8: See related comment 5 above. PREVIOUS COMMENT 9: It has been noted the proposed solar canopy structure on the northern setback is 19.2’ and does not comply with the 20’ street setback when abutting a local street (Aviation). Also, the documentation for the solar canopy structure was not provided such as the height or elevations. Therefore, the east setback from the solar canopy to the property is based ½ times height of the top of the wall. The setback cannot be verified at this time until the solar canopy documentation is provided. FOLLOW UP TO COMMENT 9: See related DDO comment 2 above. 7. Provide the square footage and the height of each commercial, industrial, or business structure and the specific use proposed within the footprint of the building(s). PREVIOUS COMMENT 10: Provide the square footage and the height of all structures as noted by the Standard above. FOLLOW UP TO COMMENT 10: See related comment 4 as it pertains to the storage container above. NEW COMMENT 11: As it relates to the proposed solar canopy height on sheet 3 (TS-3), Per UDC 7.4.6.E.2., “The minimum height clearance along access lanes and PAALs is 15 feet, except as follows. The minimum height clearance within parking garages may be less than 15 feet as permitted by the City ’s adopted Building Code.” 8. Show on-site pedestrian circulation and refuge utilizing location and the design criteria in Section 7-01.0.0, Pedestrian Access, of the Technical Standards Manual. PREVIOUS COMMENT 12: Show on-site pedestrian circulation and refuge utilizing location and the design criteria in Section 7-01.0.0, Pedestrian Access, of the Technical Standards Manual as noted by the Standard above. FOLLOW UP TO COMMENT 12: Comment 12 is still applicable and additional comments may be forthcoming based on parking design, location, and accessible parking spaces requirements. 10. Show refuse collection areas, including locations of dumpsters, screening location and materials, and vehicle maneuverability, fully dimensioned, and access route. If dumpster service is not proposed, indicate type of service. For specific information on refuse collection, refer to Section 8-01.0.0, Solid Waste and Recycle Disposal, Collection, and Storage, of the Technical Standards Manual. Refuse collection on all projects shall be designed based on that section, even if collection is to be contracted to a private firm. PREVIOUS COMMENT 13: Provide the information on the plan as noted by the Standard above. FOLLOW UP TO COMMENT 13: Based on the most recent aerial and street view images there is a dumpster located within the proposed solar canopy parking location. Dumpster curbside pickup cannot be verified if it has been allowed by Environmental and General Services. Verification of dumpster waste pickup will need to be provided. There are existing facilities within the development which are depicted upon the plan; the existing overhead service line must be moved to maintain proper clearance to the new structure. Enclosed is a copy of a TEP facilities map showing the approximate location of the existing facilities. Any relocation costs will be billable to the customer. To apply for electric service, please call the New Construction department at (520) 918- 8300. Please submit a final set of plans including approved site, electric load, paving off-site improvements and irrigation plans. If available, include a PDF version of the plans.
