This plan has been reviewed for compliance with applicable development criteria in the City of Tucson Unified Development Code (UDC) Administrative Manual (AM) Section 2-11 and Technical Manual (TM) Section for landscape, native plants, and water harvesting.

Please resubmit revised drawings along with a detailed response letter, which states how all of the Site Landscape/NPPO Section review comments have been addressed.

SITE LANDSCAPE/NPPO SECTION COMMENTS:

1. The development is commercial land use adjacent to a residential zone. It is the same property owner on both parcels, but this situation does require an interior landscape border with a 5’ masonry wall. See table 7.6.4-1 for land use to zone requirements. Will the propety to the south be rezoned as commercial? If that is the plan, then the wall may not be required. The rezoning would need to be approved prior to lifting the requirement for the masonry wall. Please update the planting plan to show the calculation for interior landscape border shade trees and add the masonry wall to the landscape and civil plans. It looks like you may be short a tree or two along that property line.

2. Label the existing and future ROW lines along Speedway and along Camino Miramonte. Work with the civil to make sure this information is the same on all plans in the set.

3. Add linework and label sight visibility triangles at the access points on all plans in the landscape set. Make sure that all plant material size and placement are following the SVT planting requirements.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is November 28, 2025.

SECTION 2-06.0.0: DEVELOPMENT PACKAGE (TENTATIVE PLATS AND SITE PLANS)


CONTENT REQUIREMENTS

2-06.4.2.B - A brief legal description and a statement as to whether the project is a re-subdivision are to be provided. On re-subdivisions, provide the recording information of the existing subdivision plat;

1. COMMENT: 2-06.4.2.B – The legal description provided on the cover sheet should be updated to match that in the lot split permit (S21-061) once approved.

This comment was not completely addressed. A review of permit S21-061 shows that the legal descriptions on that document do not match the legal description on these resubmitted plans.

2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

Zoning and Land Use Notes


2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses.

2. COMMENT: 2-06.4.7.A.4 – Identify the existing use (vacant) and proposed use. This use corresponds with “Commercial Services Use Group – Food Service, Excluding Soup Kitchens”.

Given the post-review approval to use “Retail Trade Use Group – Food and Beverage Sales” instead of “Commercial Services Use Group – Food Service, Excluding Soup Kitchens” and utilize the more favorable parking standards, please change the proposed use to the new retail use.


2-06.4.7.A.8 - For development package documents provide:


2-06.4.8 - Existing Site Conditions
The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided.


2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

2-06.4.9.E - Proposed land splits or existing lot lines shall be drawn on the plan with dimensions and the identification number and approximate square footage of each lot. (Please be aware that, if land division occurs and the number of lots falls within the definition of subdivision, a subdivision plat is required.) Land splits require a separate permit and review.

3. COMMENT: 2-06.4.9.E – This application cannot receive final Site Zoning approval until land division permit S21-061 is approved.


2-06.4.9.H.5 - If utilizing parking area access lanes (PAALs), they shall be designed in accordance with Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC.

4. COMMENT: 2-06.4.9.H.5 – Show compliance with UDC Section 7.4.6.F.2.a, which states “Access lanes and PAALs must be setback at least one from: A structure when the access lane or PAAL serves as a drive-through lane.

Acknowledge from the comment response letter the intent to meet this requirement, but please dimension the setback from the structure to the drive-through lane on the site plan.


2-06.4.9.R - Show on-site pedestrian circulation and refuge utilizing location and the design criteria in Section 7-01.0.0, Pedestrian Access, of the Technical Standards Manual.

5. COMMENT: 2-06.4.9.R – Per UDC Technical Standards Manual (TSM) Section 7-01.3.03.A, pedestrian circulation “must connect all public access areas of the development and the pedestrian circulation path located in any adjacent streets.” No pedestrian circulation path is shown from the restaurant to the existing sidewalk along E Speedway Bl.; one is required.

This comment was not adequately addressed. The proposed crosswalk which connects to E. Speedway Bl. terminates at the back of the accessible parking space and does not connect to the building. As an alternative, you can have the sidewalk from E Speedway Bl come down straight, remove the stop in front of the crosswalk, connect to the accessible parking loading area directly the building and place a caution sign as a warning to drivers.

This note was discussed with Site Engineering.
