The development site occupies parcel numbers 140-28-012A, covers approximately 8.37 ± acres, and is zoned as Residence Zone 2 (R-2). The nearest major roadway intersection is South Sears Boulevard and East Ginter Road, approximately 50 feet to the southeast of the subject development. This site does lie within the City of Tucson Airport Environs Overlay Zone – AEZ Height Zones, City of Tucson Airport Environs Overlay Zone – Airport Hazard District, Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace. According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this proposed project resulted in the following responses: 1. Your proposed structure exceeds an instrument approach area by 30 feet and aeronautical study is needed to determine if it will exceed a standard of subpart C of 14CFR Part 77. The FAA, in accordance with 77.9, requests that you file. 2. Your proposed structure is in proximity to a navigation facility and may impact the assurance of navigation signal reception. The FAA, in accordance with 77.9, requests that you file. 3. 77.9(b) by 4 ft. The nearest airport is TUS, and the nearest runway is 04/22. 4. The FAA requests that you file. The Tucson Airport Authority is requiring a resubmittal of this project. Conditions of approval: 1. “The applicant shall file FAA Form 7460 with the FAA at least 45 days before construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA), provides the project applicant with written communication that filing FAA Form 7460 is not required. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp” 2. “Development of the subject property shall not cause or potentially affect aviation in the vicinity of the site, determined in the reasonable judgment of the Tucson Airport Authority, including but not limited to, physical obstructions to aircraft operations, interference with operations by way of electrical static, visual obstructions through emissions or glare, and/or the open storage of petroleum products, explosive materials, or materials which attract or lead to the concentration of wildlife.” 3. For Tucson Airport Authority note #1, revise the distance from Tucson International Airport from being 1 ½ miles to instead be 1,425 feet north of Tucson International Airport. Due to this project’s close proximity to Tucson International Airport, being in close proximity to the active crosswind runway at Tucson International Airport (presently identified as Runway 4/22), and other active aeronautical operations in the vicinity of this proposed project, it is recommended that you consider using high quality construction techniques and high quality construction materials to reduce the interior sound level, within the habitable spaces of the residential uses, to be no greater than 45 decibels (dB). You may also want to consider installing sound insulation treatment measures within the proposed residential uses to ensure that the interior sound level is no greater than 45 decibels (dB). As of this letter, the 65 DNL (the Day-Night Average Sound Level over a 24-hour period), does not occur over this proposed project area. Future changes in the use of airspace in proximity to Tucson International Airport, the types and frequency of aircraft operating at Tucson International Airport, and new aeronautical uses that are presently not at Tucson International Airport could result in the existing 65 DNL or higher noise contour to occur over this proposed project area. Per Sec 10-01.2.3 of the UDC Technical Standards Manual the minimum pavement width for roadways with 2 parking lanes is 32ft. The proposed 24’ wide pavement width does not support on-street parking. 2. Per Sec. 10-01.4.4.F of the UDC Technical Standards Manual the 10yr flood discharge from Basin 1 will have to be directed under the sidewalk along Ganley Rd. 3. Per Sec. 10-01.3.3 a pedestrian circulation path is required along the entire street frontage of a new development. 4. Per Sec. 1-01.3.3.E curb access ramps must be provided at all points where the sidewalk intersects a curb and must align with each other where they cross the street. Section 3.3.4 of the Drainage Report states that dumped riprap over filter fabric will be used on the 2:1 side slopes to the north and east of the basin. This is also stated on detail D on sheet 6 of the plan set. Per DSSDR Table 4.1, the riprap shall be hand placed for this slope. Please revise this section of the drainage report and detail D on sheet 6 of the plan set, and state this on sheet 4 of the plan set as well. 2. Table 4 of the Drainage Report should read "Existing Onsite Hydrology Results" and the first figure in Appendix A should read "Figure A-1 Existing Conditions Exhibit" - please revise. 3. It is difficult to discern the sediment wattle on the SWPPP plan due to the line type. Please use a different line style/color for the erosion control mechanism and ensure that it is shown around the entire perimeter of the site. 4. Provide the low point elevation on each lot and include a detail for both front draining and rear draining lots. Please resubmit revised drawings along with a detailed response letter, which states how all Landscape/NPPO Review Section comments are addressed. SITE LANDSCAPE/NPPO SECTION COMMENTS: 1. Ensure that Zoning and Engineering comments are addressed prior to landscape section approval. 2. Label property lines, existing and future ROWs on all sheets in the landscape plan set. 4. A few of the plants within the north, west and south street landscape border are partially within the ROW. Move the plants so that they are completely on property or reach out to DTM for review and approval of the planting and irrigation in the ROW. Are depressed street landscape borders planned for this development? If so, add contouring that matches the civil grading plan and add a note to the planting plans to depress street landscape border areas to maximize water harvesting on-site. 6. Possibly add to Landscape Note #6, on sheet 17 of 21, tree relocation due underground utility conflicts in addition to the already accounted for driveway placement. 7. Add leader callouts to the planting plan sheets that call out the functional open space areas. Are the total square footages only the basin on the north or are there other areas that are counting towards the total open space area? This will simplify the review. 8. Where hydroseed is called out on the planting plans, add reference to where the hydroseed mix can be found on sheet L-1. 9. Add Ocotillo, Cacti and Groundcover planting details to the plan set. This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is , 2025. 2-06.4.0 CONTENT REQUIREMENTS 1. COMMENT: 2-06.4.1 – Provide the phone number for the Owner listed on the cover sheet. 2. COMMENT: 2-06.4.3 – Provide the development package case number, TD-DEV-0824-00236, adjacent to the title block on all sheets. 2-06.4.7 - General Notes The following general notes are required. Additional notes specific to each plan are required where applicable. 2-06.4.7.A - Zoning and Land Use Notes 3. COMMENT: 2-06.4.7.A.4 – The Use Specific Standards listed under Zoning and Land Use Note 6 do not apply to a Flexible Lot Development. Review UDC Table 4.8-2 and provide the correct Use Specific Standards. 2-06.4.9 - Information on Proposed Development The following information on the proposed project shall be shown on the drawing or added as notes. 4. COMMENT: 2-06.4.9.O – Under Flexible Lot Development Package Calculations 6 you list the “PERIMETER YARD” “10’”. Zoning assumes you are talking about the east perimeter property boundary, adjacent to the R-2 property to the east. The 10’ setback is not correct. Per UDC Table 6.3-2.A the required setback is 6’-0” or 2/3 (H) greater of the two. 5. COMMENT: 2-06.4.9.R – It appears that a pedestrian access ramp is proposed at the southeast corner of Basin 1. Clearly demonstrate that the requirements of ICC A117.1-2009 Sections 405 & 505 are met. 6. COMMENT: 2-06.4.9.V – Clarify what type of mail delivery is proposed. If gang mailboxes are proposed clearly shown them on the plan. 7. COMMENT: 2-06.4.9.W – Indicate the location of any signs and provide a note stating all signs require separate permits. 2-06.5.0 FLEXIBLE LOT DEVELOPMENT (FLD - ADDITIONAL REQUIREMENTS) 2-06.5.3 Additional Information The following are required in addition to the requirements of the tentative plat or site plan, whichever is applicable: 8. COMMENT: -06.5.3.B – Under Flexible Lot Development Package Calculations you state that you are using “ALTERNATE “B” Maximum Density Option. Clearly demonstrate how you meet the requirements of UDC Article 8.7.3.C.3.b. 9. COMMENT: 2-06.5.3.D – Provide dimensioned building elevations of all proposed units. 10. COMMENT: 2-06.5.3.E – Provide an architectural variation plan with the next submittal or provide a general note stating that the plan will be submitted and approved prior to issuance of the first building permit. 11. COMMENT: 2-06.5.3.F – A privacy mitigation plan is required in accordance with UDC Article 8.7.3.M.2.d 12. COMMENT: 2-06.5.3.F.1 – Identify on the tentative plat or site plan the lots and/or units that must provide privacy mitigation; 13. COMMENT: 2-06.5.3.G.2 – Provide two copies of the protective covenants or common use agreements for any shared areas being established by easements over individually-owned property.
