Thank you for the opportunity to comment on TD-DEV-0823-00371, the development plan for a
new community park featuring small parking area, splash pad, playground, and restroom
building at 329 E Elvira Rd. This development is located in the S.W quarter and the S.E. quarter
of the N.E. quarter of Section 13, Township 15S, Range 13E, of the Gila and Salt River
Meridian. The development site occupies parcel number 138-15-0020 and 138-16-0230 and is
zoned as Residence Zone 2 (R-2). The nearest major roadway intersection is East Elvira Road
and South Nogales Highway, approximately 825 feet to the southeast of the subject
development.
This site does lie within the Tucson International Airport avigation easement requirements and
public disclosure area, FAA traffic pattern airspace, FAA Part 77 airspace, City of Tucson
Airport Environs Zone – Height Zone, and City of Tucson Airport Environs Zone – Airport
Hazard Districts.
Below are the responses that the Tucson Airport Authority received for trees with a maximum
height of 40 feet and a site elevation of 2,545 feet.
1) Your proposed structure exceeds an instrument approach area by 12 feet and
aeronautical study is needed to determine if it will exceed a standard of subpart C of
14CFR Part 77. The FAA, in accordance with 77.9, requests that you file.
2) Your proposed structure is in proximity to a navigation facility and may impact the
assurance of navigation signal reception. The FAA, in accordance with 77.9, requests
that you file.
3) The FAA requests that you file.
The Tucson Airport Authority is requiring a resubmit of this project. These conditions must be
included in the development plan document and shall be identified in the general notes section
of all future plans submitted to the City of Tucson for review.
Conditions of approval:
1. “According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this project
area is located in proximity to a navigation facility and could impact navigation signal
reception and impacts an instrument approach area. As this project site develops, all
applicants shall file FAA Form 7460 and conduct an aeronautical study with the FAA at
least 45 days before construction activities begin unless FAA staff, with the Obstruction
Evaluation / Airport Airspace Analysis (OE/AAA), provides the project applicant with
written communication that filing FAA Form 7460 is not required. It is highly
recommended that the applicant file earlier than 45 days to provide the applicant with
sufficient time to respond to any concerns which are identified by the FAA. Any cranes
which are used must also be identified with Form 7460. Please file Form 7460 at
https://oeaaa.faa.gov/oeaaa/external/portal.jsp”

2. Curb and Sidewalk required along frontage of both Elvira and Aragon.
3. Per TSM 7-01.4.3.C.6 - Compacted decomposed granite or similar material cannot be used for construction of a required sidewalk system that is part of the required accessible route or pedestrian circulation path.
4. All landscaping shall be depressed for water harvesting.
5. Lot Combination and title report required prior to approval.
6. Separate building permits required for installation of structures.

This plan has been reviewed for compliance with applicable development criteria in the City of Tucson Unified Development Code (UDC) Administrative Manual (AM) Section 2-11 and Technical Manual (TM) Section for landscape, native plants, and water harvesting.
Please resubmit revised drawings along with a detailed response letter, which states how all Landscape/NPPO Review Section comments are addressed.

COMMENTS:
1. Ensure that Zoning, Engineering comments, and concerns are addressed before landscape section approval.
2. Provide the development package case number, TD-DEV-0823-00371, adjacent to the title block on all sheets. 2-06.4.3
3. NPPO is waived due to the number of new plantings that will occur on site that are all native, near-native, or low-water use plantings which will outnumber the existing limited plant material currently on site.
4. Re-order the plan set so that landscape & irrigation sheet sets fall one after the other for ease of review and use.
5. The Grading Plan shows proposed depressed water harvesting basins in both the dog park and running north to south on the west side of the proposed splash pad. Please label these on the landscape & irrigation plans.
6. Can the area to the east of the splash pad located within the walking loop also be graded to capture more rainwater?
7. A commercial rainwater harvesting plan is not required for this site for the following reasons: 1. It is not a commercial site, it is a public park and 2. As more than 70% of the total area is pervious surfacing (dg or plantings), the site itself naturally lends itself to rainwater harvesting.
8. Include curb cuts at parking lot tree planting areas, unless using flush curbs and parking blocks.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is October 4, 2024.

COMMENT: Provide the proposed use and any use-specific standards applicable.

6. 2-06.4.7.A.6 - If a plan or plat is prepared in conjunction with other applications or overlays or the parcel being developed is subject to conditions of an application processed previously, additional information must be added to the plan. Such applications and overlays include, but are not limited to: annexations; rezonings; special exceptions; Board of Adjustment variances; Design Development Options; Technical Standard Modification Request; overlays (Airport Environs Zone, Environmental Resource Zone, Gateway Corridor Zone, Hillside Development Zone, Historic Preservation Zone, Major Streets and Routes, Rio Nuevo District, Scenic Corridor Zone, WASH); Modification of Development Regulations through the Downtown Area Infill Incentive District or Rio Nuevo District; Downtown Heritage Incentive Zone; or, Design Review Board. Provide the following information on the plan.
COMMENT: Project location is within AEZ overlay. Acknowledge and list which portions of the overlay apply to this site as a general note.

7. 2-06.4.7.A.8.a - Floor area for each building;
COMMENT: Provide the square footage and height of each building proposed on site.

8. 2-06.4.8.C - The following information regarding existing private or public right-of-way adjacent to or within the site shall be provided: the name, right-of-way width, recordation data, type and dimensioned width of paving, curbs, curb cuts, and sidewalks.
COMMENT: Provide ROW information as described above for East Elvira Rd and East Aragon Rd.

9. 2-06.4.9.A - Draw in all proposed lot lines with approximate distances and measurements.
COMMENT: A lot combination will be required.

10. 2-06.4.9.F - All existing zoning classifications on and adjacent to the project (including across any adjacent right-of-way) shall be indicated on the drawing with zoning boundaries clearly defined. If the property is being rezoned, use those boundaries and classifications. The basis for this requirement is that some zoning requirements on a project are based on the zoning classification of adjacent property. Also, in some instances, each zone has to be taken into consideration on property that is split by two or more zoning classifications, as each may have different requirements.
COMMENT: Please provide information described above.

11. 2-06.4.9.G - If the project is to be phased, provide calculations, setbacks, etc., to indicate that each phase complies with all requirements as a separate entity. Show phase lines on the drawing. Show and label any temporary improvements that may be needed to make the site function for each phase as one entity. If such temporary improvements are off the site of the phase under consideration, a temporary easement or other legal documentation to assure legal use of the property is required. Note recording information.
COMMENT: “Future Dog Park Location” and “Future Park Expansion Area” shall be identified as being completed under future development package.

12. 2-06.4.9.H.5 - If utilizing parking area access lanes (PAALs), they shall be designed in accordance with Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC.
COMMENT: UDC Section 7.4.6.K – the use of a street for maneuvering is not allowed. Demonstrate compliance with this section on next submittal.

13. 2-06.4.9.H.5.a - Show all motor vehicle off-street parking spaces provided, fully dimensioned. As a note, provide calculations on the number of spaces required (include the ratio used) and the number provided, including the number of spaces required and provided for the physically disabled. The drawing should indicate parking space locations for the physically disabled. A typical parking space detail shall be provided for both standard parking spaces and those for the physically disabled. For information on parking requirements for the physically disabled, refer to adopted building and accessibility codes of the City of Tucson. Design criteria for parking spaces and access are located in Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC.
COMMENT: Provide parking calculation for proposed project.

14. 2-06.4.9.H.5.d - Show bicycle parking facilities fully dimensioned. For specifics, refer to Section 7.4.9, Bicycle Parking Design Criteria, of the UDC. Provide, as a note, calculations for short and long term bicycle spaces required and provided.
COMMENT: Provide bicycle parking calculation and identify the parking locations on site plan.

15. 2-06.4.9.Q - Provide the square footage and the height of each commercial, industrial, or business structure and the specific use proposed within the footprint of the building(s).
COMMENT: Provide heights for every structure (including shade canopies) and fences on site.
