Thank you for the opportunity to comment on TD-DEV-0723-00309, the development plan for
the TEP Vail Substation and BESS Upgrades at 10000 S Rita Rd. This development is located
in the N.E. quarter, the N.W. quarter, the S.E quarter, and a small portion in the S.W. quarter of
Section 4, Township 16S, Range 15E, of the Gila and Salt River Meridian. The development site
occupies parcel number 305-01-005A, covers approximately 200.05 ± acres, and is presently
zoned as Rural Homestead Zone (RH) but will be rezoned to Heavy Industrial Zone (I-2) as part
of City of Tucson rezoning case TP-ENT-0323-00018. The nearest major roadway intersection
is Old Vail Connection Road and South Rita Road, approximately 0.40 miles to the northeast of
the subject development.
This site does lie within the Tucson International Airport avigation easement requirements and
public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.
The Tucson Airport Authority approves the proposed project and is not requiring a resubmittal.

COMMENTS: Please resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is July 19, 2024.
