Thank you for the opportunity to comment on TD-DEV-0125-00024, 1
st Submittal, a
development plan for a new concrete masonry wall at 10000 S Rita Road. This development is
located in the N.E. quarter of Section 4, Township 16S, Range 15E, of the Gila and Salt River
Meridian. The development site occupies parcel number 305-01-005A, covers approximately
220 ± acres, and is presently zoned as Rural Homestead (RH) but is proposed to be rezoned to
Heavy Industrial (I-2) under City of Tucson Rezoning Case TP-ENT-0323-00018. The nearest
major roadway intersection is South Rita Road and East Old Vail Connection Road,
approximately 2,125 feet to the southwest of the subject development.
This site does lie within the Tucson International Airport avigation easement requirements and
public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.
Below are the responses that the FAA Notice Criteria Tool provided on the applicant’s project.
1) Based on the information you provided, you are required to file notice with the FAA. You
must submit notice at least 45 days before the start of the proposed construction or
alteration or the date an application for a construction permit is filed, whichever is
earliest.
2) Note: If you propose construction or alteration that is subject to the licensing
requirements of the Federal Communications Commission (FCC), you must submit
notice to the FAA on or before the date that an application is filed with the FCC. Visit
FCC Licensing to learn more.
The Tucson Airport Authority is requiring a resubmittal of this project.
Conditions of approval:
1. “The applicant shall file FAA Form 7460 with the FAA at least 45 days before
construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport
Airspace Analysis (OE/AAA), provides the project applicant with written communication
that filing FAA Form 7460 is not required. It is highly recommended that the applicant
file earlier than 45 days to provide the applicant with sufficient time to respond to any
concerns which are identified by the FAA. Any cranes which are used must also be
identified with Form 7460. Please file Form 7460 at

COMMENTS: Resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Per UDC Article 3.3.3.G.5.c, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is May 11, 2026.

2-06.3.0 FORMAT REQUIREMENTS

1. COMMENT: 2-06.3.7 - A small, project-location map shall be provided in the upper right corner of the cover sheet. The location map shall meet the requirements of 2-06.4.4, 2-06.4.4.A, 2-06.4.4.B & 2-06.4.4.C listed below.

2-06.4.0 CONTENT REQUIREMENTS

2. COMMENT: 2-06.4.1 – Provide the name, mailing and email addresses, and phone number of the primary property owner of the site, the developer of the project, registrant(s), and other person(s), firm(s), or organization(s) that prepared the development package documents shall be provided on the right half of the cover sheet.

3. COMMENT: 2-06.4.2.D – Provide the page number and the total number of pages in the package (i.e., sheet xx of xx) within the title block on all sheets.

4. COMMENT: 2-06.4.3 – Provide the development package case number, TD-DEV-0125-00024, adjacent to the title block on all sheets.

5. COMMENT: 2-06.4.4 - The project-location map to be located on the first sheet of the development package in the upper right corner, shall cover approximately one square mile, be drawn at a minimum scale of three inch equals one mile, and provide the following information.

6. COMMENT: 2-06.4.4.A – Show the subject property approximately centered within the one square mile area;

7. COMMENT: 2-06.4.4.B - Identify major streets and regional watercourses within the square mile area and all streets that abut the subject property; and,

8. COMMENT: 2-06.4.4.C - Section, township, and range; section corners; north arrow; and the scale will be labeled.

2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

2-06.4.7.A - Zoning and Land Use Notes

9. COMMENT: 2-06.4.7.A.1 - List as a general note: "Existing zoning is ___."

10. COMMENT: 2-06.4.7.A.2 - List as a general note the gross area of the site/subdivision by square footage and acreage.

11. COMMENT: 2-06.4.7.A.3 – As this plan has been prepared in conjunction with a rezoning application, add the following note next to the existing zoning note: "Proposed zoning is ____." List the applicable rezoning file number and conditions of approval. Also place the TP-ENT-0323-00018
in the lower right corner of each sheet.

12. COMMENT: 2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

13. COMMENT: 2-06.4.9.U – Clearly demonstrate that rezoning, TP-ENT-0323-00018, 7 is met. Provide the height of the proposed wall.

Tucson Electric Power Company (TEP) has reviewed and approved the development
plan submitted 5/12/2025. There are existing facilities within the development which are
not depicted upon the plan. Overhead and underground TEP, and non-TEP, high
voltages lines extend in and out of substation at multiple locations. Developer should
use extreme caution and follow all safety standards for work in and around the
substation.
Enclosed is a copy of a TEP facilities map showing the approximate location of the
existing facilities. Any relocation costs will be billable to the customer.
To apply for electric service, please call the New Construction department at (520) 918-
8300. Please submit a final set of plans including approved site, electric load, paving
off-site improvements and irrigation plans. If available, include a PDF version of the
plans.
If easements are required, they will be secured by separate instrument. Should you
have any easement questions, please contact our Land Resources Department,
