| 10/01/2024 | Site Zoning | REQUIRES RESUBMIT | ZONING REVIEW TRANSMITTAL FROM: Wyatt Berger Lead Planner PROJECT: TC-RES-0924-05281 5447 East Willard Street – R-1 Sleeping quarters (1st Review) TRANSMITTAL DATE: October 1, 2024 The site is in the R-1 zone (UDC 4.7.8). A single-family dwelling is a permitted use in the R-1 zone, subject to use-specific standards 4.9.7.B.5-.9. COMMENTS: 1. Clarify whether the proposal is a sleeping quarters or an accessory dwelling unit (ADU). Per a previous Zoning Administrator’s determination dated May 29, 1996, for the proposal to not be considered a dwelling unit, the sleeping quarters is limited to having a refrigerator that can fit below a sink counter, a wet bar sink, and no cooking facilities. If an ADU is proposed, the proposal shall comply with use-specific standards 4.9.7.B.6, .8, and .9, and 6.6.3. 2. Clarify the number of bedrooms in the existing dwelling and proposed sleeping quarters. Per use-specific standard 4.9.7.B.7, for any new single-family dwelling in the R-1 zone with five bedrooms, three parking spaces are required. For every bedroom over five, one additional space is required for each bedroom. For all single-family dwellings in the R-1 zone with five or more bedrooms, all parking spaces must be located on-site, either in a side or rear perimeter yard. Parking spaces may not be located in a vehicular use area in any front street perimeter yard. A parking area is not required to be developed to a commercial standard. A dustproof parking surface is required to at least a minimum of two inches of compacted pea gravel. An existing covered residential parking area may be used. Per UDC 11.4.3, the term bedroom includes all of the following: 1) Any room that is designated as a bedroom; 2) Any enclosed room that has a minimum area of 60 square feet and has an accessible opening to the exterior of the building in compliance with the International Building Code (IBC), whether termed a studio, family room, study, den, bonus room, or any other name, except for a living room, dining room, kitchen, and bathrooms; and 3) Any room designated as a bedroom for the purpose of any other code requirement. Note that the above use-specific standard does not apply to the proposal if an ADU is proposed. 3. Please be aware that if an ADU rather than a sleeping quarters is proposed, a Design Development Option (DDO) will be required to reduce the side and rear perimeter yards. Per UDC 6.6.2.D, signed neighbor waivers cannot be utilized to reduce the perimeter yard requirements of an ADU. 4. A detached carport or shade structure appears in the front yard in 2023. Site Zoning has concluded that this carport was not reviewed and approved by the Planning and Development Services Department. Notate the location of the carport on the site plan and provide the square footage, post heights, and applicable perimeter yard setbacks. Further, label the distance between the centerline of Willard Street to the face of curb, and from the face of curb to the street property line. According to sheet two of paving plan I-842-002, for 60-foot-wide rights-of-way, the distance between the centerline of Willard Street and the face of curb is 18 feet, and the distance between the face of curb and the street property line is twelve feet: https://maps-and-records.tucsonaz.gov/construction-plans/details/I-842. Please be aware that if an ADU rather than a sleeping quarters is proposed, the carport will need to be reviewed under a separate building permit. 5. Per UDC 6.4.5.B.2, a vertical structural member such as a post or column supporting a roof extension is considered a wall for applying setback requirements. Per UDC 6.4.5.D.3.a, the minimum required front street setback is ten feet as measured from the street property line. If the existing carport does not meet the minimum required front street setback, a Design Development Option (DDO) is required. The DDO application and requirements can be found at: https://www.tucsonaz.gov/files/sharedassets/public/v/1/pdsd/documents/planning-amp-zoning/ddo_for_setback_and_height_udc.pdf. Contact Georgia.Pennington@tucsonaz.gov or Mark.Castro@tucsonaz.gov if you have questions about the DDO process. 6. Please be aware that if the unpermitted carport is 400 square feet gross floor area or greater, and/or the total gross floor area of all accessory structures exceeds 50% of the gfa of the principal structure, a variance granted by the Board of Adjustment will be required to allow the carport to remain (see UDC 6.6.3.C and UDC 6.6.3.E). If you have any questions about this transmittal, contact me at Wyatt.Berger@tucsonaz.gov or at 520-837-4951.
