COMMENTS: Please resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This site is located in the R-1 zone (UDC 4.7.8). A single-family residence with an accessory dwelling unit (ADU) is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.6, 8, & 9 and 6.6.3.

1. A new address is required for the ADU.

2. Both permits reference the ADU but one should be for the carport & laundry addition to the existing dwelling and one for the ADU. On the next submittal ensure that the descriptions are clear so that applicable comments can be applied to the correct permit. The permit that is selected for the ADU will need to reflect the new address.

3. Provide a dimension from the centerline of both streets to the face of curb, where pavements meets the concrete curb, and from face of curb to the street property line. The distance from the centerline of 3rd to face of curb is 19.6’ and from face of curb to street property line is 20.0’. The distance from the centerline of Bentley to face of curb is 18’ and from face of curb to street property line is 12.0’.

4. Clearly demonstrate that the requirements of UDC Article 6.6.3.B.2 & .3 are met.

COMMENTS: the following comments are relative to an application for a Design Development Option (DDO) (UDC 3.11.1).

Perimeter yard setbacks are based on a wall height measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A.

ADU:
The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A).
1. Based on a wall height of 12’-0” the required perimeter yard setback from the proposed ADU to the east property line is 8’-0”, proposed setback is 3’-0”.


Carport and laundry addition to main dwelling:
The minimum setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A).
2. Based on a wall height of 10’-10” the required perimeter yard setback from the proposed carport to the east property line is 7’-3”, proposed setback is 6’-0”.
3. Based on a wall height of 9’-10” the required perimeter yard setback from the proposed laundry to the east property line is 6’-7”, proposed setback is 6’-0”.

Detached Garage:
For carports and garages which face the street , the minimum required street perimeter yard is 20 feet regardless of the street . (UDC Section 6.4.5.C.1.b).

4. Proposed street perimeter yard setback from the proposed detached garage to west street property line is 1’-0”. As the UDC only allows for a reduction to 18’-0” for the proposed garage, UDC Article 6.4.5.C.1.c.(1) under the DDO process, a Board of Adjustment for Variance is required to reduce the garage setback to 1’-0”.
