COMMENTS: Provide a detailed response letter with your submittal that clearly shows how you have addressed all Zoning comments.

This site is located in the R-1 zone (UDC 4.7.8). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.5 - 9.

1. If you are attempting to permit the unpermitted addition a residential plot plan is required the meets the requirements found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Permits/Plan-Examples/Plot-Plan-Example, to include but not limited to:
a. Provide a lot coverage calculation that meets the requirements of UDC Article 6.4.3 and the example shown on the Residential Plot Plan Requirements.
b. Provide the legal description, “WILMOT DESERT ESTATES RESUB LOTS 25 26 27 & 28
LOT 10 BLK 1” on the plot plan.
c. Show all utility lines on the plot plan.

2. The submitted site plan states that the proposed new building is “10’ (H)” but the submitted construction plans from American Steel sheet 3 show the wall height as 12’. Per UDC Article 6.4.4.A and Figure 6.4.4-A, building height for this type structure is a measurement from design grade to the midpoint of a pitched roof. Based on the 12’ mentioned above the building height exceeds the allowed 12’ for a detached accessory structure, UDC Article 6.6.3.D. If you are proposing heights not shown on the submitted plans provide fully dimensioned elevations for what you are proposing. If the building height exceeds the allowed 12’ a Board of Adjustment for Variance will need to be submitted and approved to exceed the allowed height.

3. Per UDC Table 6.3-2.a the required interior perimeter yard setback from the proposed metal building to the north property line is 6’-0” or 2/3 (H), (H) = Height of the proposed exterior building wall, greater of the two. Perimeter yard setbacks are based on a wall height measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A. Based on the 12’ shown on American Steel sheet 3, the required perimeter yard setback from the proposed metal building to the north property line is 8’-0”, proposed setback is 0’-0”. Per UDC Article 6.6.2.D An accessory structure that exceeds the allowable height of a wall within a perimeter yard and is detached from a principal structure shall comply with the perimeter yard width standards of the principal structure, except that the accessory structure may be built to a parcel line with the consent of the adjoining or, when separated by an alley, adjacent property owner(s). To secure this neighbor’s setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s):
My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan.

If you are not able to secure this waiver a Board of Adjustment for Variance will be required to reduce the perimeter yard setback to 0’-0”.

4. The ‘Ex. Cov Proch” shown on the plan shows up on aerial photos sometime after 2022. Zoning was not able to find approved permit documents for this porch. As it appears this porch is attached to the main dwelling a building permit is required. Either 1) Provide approve permit documents, 2) Provide building plans for this porch and include in this permit, or 3) show the porch to be removed.

5. Based on permit T12CM07207 there was a greenhouse in the same location as the proposed structure. Zoning was not able to find an approved demo permit for the greenhouse. As a permit was required to build the greenhouse a demo permit is required.
