This site is in the R-1 Residence Zone (UDC 4.7.8). A single-family residence is permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9 for 1 unit.

The City's Unified Development Code (UDC) (Section 1.4.1.C) establishes that before the City issues any approvals or permits; we must confirm that a site complies with UDC standards. Therefore, as part of permit reviews, we review a site's permit history and compare it to aerial photography to confirm that unpermitted work has not occurred. In many cases, this does mean that a homeowner must apply for permits for unpermitted work before we can approve any new work on that site.

Plan review for the above referenced shade ail has been completed. This letter reflects comments to be addressed. For facilitating a shorter back check time, please provide updated plans and calculations with a written response to each of the notated items indicating action taken. Do not cloud the changes made for comment updates; revisions are processed if changes occur after the permit is issued.

1. COMMENT: Zoning acknowledges receipt of the approved Design Development Option (DDO) DDP-26-24 submittal, TP-MOD-0226-000019. Unfortunately, the dimensions provided on that site plan from the centerline of E Hayne St to the front curb and front of curb to the north property line are not correct.

Update dimensions per on the site plan https://maps-and-records.tucsonaz.gov/construction-plans/details/I-577 , sheet 6. Know that this may affect the post location as the total math that is ‘off’ is 5’-0” south toward the existing residence (where the proposed post location was approved).

Should this prove to be the case, three options exist:

a) Withdraw the permit and do not install shade sail.
b) Redesign shade sail size and post location to reflect actual location of north property line.
c) Leave post in same location and if it lands on the property line, a Board of Adjustment Variance (not DDO) would be required.

Information for that process can be found at the end of this review.

2. COMMENT: The site plan provided is incomplete.

A. Draw, label and dimension everything that exists on the property to a scalable drawing graphic (examples include the principal residence, porches, breezeways, sidewalks, driveways, parking spots, walls, fences, ramada, shed, carport, shade sail, cistern, pool, guest house, sleeping quarters, accessory dwelling unit) and provide dimensions of any structure as it relates to nearby structures and property lines and provide the heights (measured from above finish grade to top of wall, etc.) of those structures that run parallel-perpendicular to any nearby adjacent property lines. Provide heights at various locations along the fence/wall if applicable. Label missing parking (if applicable).

Provide missing unpermitted shade sail at the southwest corner of the residence.

B. Update Parcel number from 001010010 to 126-17-0610.

C. Update Township from T:14 to T:14S and Range from R:14 to R:14E

D. The property line lengths are incorrect. Update the property line lengths and 4’-0” wide easement along south property line to be reflective in the property title report. Refer to Pima County’s website https://www.asr.pima.gov/ParcelData/Map/Arm/MP06/06098.PDF . The math of the property line lengths will produce an updated total parcel square footage number and affect the lot coverage table calculation numbers. Update accordingly.

E. Provide R-1 zoning labels on all four sides of this parcel.

F. The scale noted does not match the plan graphics on the site. Update the graphics to match the scale noted or vice-versa.

3. COMMENT: After reviewing the property documentation history in Property Research Online (PRO), zoning could not verify any permit documentation for the existing shade sail to the southwest of the principal residence, and the 175 sf shed whose permit (TC-RES-0323-03235) expired in March 2023.

Zoning will not be able to approve the permit application until the permit information is provided. If permit documentation cannot be provided, all structures less than 200 square feet can be included in this permit.

Provide dimensions of both structures to their respective adjacent property lines and acknowledge in the comment response letter your desire that have these included in the permit.

4. COMMENT: Additional comments may be forthcoming on the next review based on responses to Zoning and other PDSD reviewer comments.
