Your petition of appeal to the building official has been denied. The request sought additional clarification on a plan review comment to provide rapid shutdown in accordance with NEC 690.12 for the removal and replacement of an existing photovoltaic (PV) system. The stated justification for this appeal does not provide an equivalent means of compliance to meet the intent of the code to protect firefighters from shock hazard. If granted, this modification would lessen the life-safety provisions of the adopted building codes.

The scope of work for permit TC-COM-0126-00137 includes the removal and reinstallation of a roof-mounted PV system to accommodate the re-roofing of an existing building. The reinstallation of the electrical equipment, components, and conductors is subject to the installation requirements of the currently adopted building codes including but not limited to NEC 690.12. The purpose of the NEC is the “practical safeguarding of persons and property from hazards arising from the use of electricity” (90.2(B)). Reinstallation without rapid shutdown would reintroduce a known and specially addressed life-safety hazard.

Please note, there are two exceptions stated in 690.12 to avoid the installation of rapid shutdown, neither of which apply to the scope of this permit application. The installation of rapid shutdown is consistent with Article 110.12 requiring the reinstallation to be installed “in a professional and skillful manner” and Article 690.13 for system disconnecting means.
