Design Review - Standard REQUIRES RESUBMIT The Design Professional has recommended Conditional Approval of the submitted design package, and provided the following conditions:
A. The windows in the stairwell are changed to square rather than vertical rectangular.
B. The COT Tucson PDSD resolve the apparent conflict between the NPZ Guidelines and State Law regarding ADU size.
C. The applicant clarifies this is for both ADUs and that both are intended to be constructed.
D. The balcony dimension exceeding 5' is resolved by PDSD.

Upon further review of the Jefferson Park Design Manual, page 14: "The floor area of the second floor(s) shall not exceed 5.25% of the total lot area." The total second floor area of the proposed ADUs exceeds this maximum, which must be resolved before approval in addition to the oversizing of the balconies. The submitted design package stated the maximum second floor coverage is 25%, which is incorrect.

Regarding the state law and ADUs, the guidelines for permitting ADUs is that they can be no more restrictive than other residential development in an area - the size and lot coverage requirements of the Jefferson Park Neighborhood Preservation Zone would apply to all development within that zone, and so apply to ADU structures.
