Permit Description: Tucson Electric Power Company (TEP) is requesting a Zoning Administrator Determination for clarification of the Zoning Examiner’s authority to place conditions on Special Exception Land Uses (SELU) that may be less than or in excess of what is required by the Use Specific Standards that govern the use. More specifically, TEP requests a determination that the Zoning Examiner is empowered by the City of Tucson’s Unified Development Code (UDC) to condition the issuance of a Special Exception Land Use Permit for a TEP substation by granting relief of setback requirements and wall height standards when strict adherence does not further the overall intent and purpose of the UDC.
